Subject: Sentencing Enhancement for Indecent Exposure of a Sexual Nature
 
In the near future, I am planning to introduce legislation that will provide a sentencing enhancement in certain circumstances when an individual commits indecent exposure. Specifically, my bill will make the sentencing enhancement applicable anytime an individual commits indecent exposure for the purpose of sexual arousal or sexual gratification.

There has been a proliferation of indecent exposure charges of late where the nature of the incident was sexual. Instances in Cumberland, Snyder, and York County, to name a few, have threatened the safety and integrity of public areas where families and children gather.

Under current law, there is no increased penalty for the crime of indecent exposure if the perpetrator committed the act for a sexual purpose. My legislation will attempt to remedy this loophole, by asking the Sentencing Commission to provide a sentencing enhancement within its guidelines when a person commits indecent assault for the purpose of sexual arousal or sexual gratification. It’s imperative that, in order to keep our communities safe, we consider charges of this nature seriously and hold individuals accountable.
