Subject: Protecting Vulnerable Individuals at Risk of Losing Their Homes

As a former Court-Appointed Guardianship Attorney, I saw clients who lost their homes as a result of unpaid property taxes. Too often, these were individuals with dementia or those who were otherwise incapacitated and were unable to pay their tax bills without assistance. Tragically, in many instances these incapacitated individuals had the financial means to pay their taxes.  Unfortunately, their families were not made aware of the unpaid taxes until it was too late to help, resulting in the house being sold off at a Sheriff’s auction.

My legislation would help vulnerable older adults and incapacitated individuals remain in their homes by creating an option for them to designate a person to receive notice should their property taxes fall into arrears. Vulnerable individuals should not be at risk of losing their homes due to circumstances beyond their control. This legislation would guarantee an opportunity for a family member or other caregiver to assist an older adult or incapacitated individual in keeping their home.

This legislation previously passed in the House with overwhelming bipartisan support when it was introduced during the 2023-2024 Legislative Session as House Bill 1646. Such profound support indicates the great need for this type of protection for our most vulnerable family members and neighbors.

Please join me in co-sponsoring this important legislation that will make a few simple changes to the Sheriff sale process yet have a massive impact on vulnerable individuals and their families.
