Senate of Pennsylvania
Session of 2025 - 2026 Regular Session

MEMORANDUM

Posted: December 2, 2024 02:04 PM
From: Senator Doug Mastriano and Sen. Cris Dush
To: All Senate members
Subject: Right To Bear Arms Act

In the near future, we intend to re-introduce ( SB 551 Last Session) the Pennsylvania Right to Bear Arms Act.

This legislation, among many provisions, will prohibit the enforcement of any new federal restriction, prohibition or registration requirement for firearms, magazines and ammunition.

Additionally, our legislation would prohibit the use of any state or local resources to enforce any new federal restriction, prohibition or registration requirement on the purchase or ownership of firearms, and firearm accessories, which are currently legal products in Pennsylvania.

Pennsylvania’s protections regarding the right to bear arms pre-date and influenced the federal constitution.

In fact, Pennsylvania was the first state to address the right to bear arms in its constitution – by the time the Second Amendment to the United States Constitution was adopted in December of 1791, PA had already reaffirmed twice the right to bear arms as a fundamental individual freedom.

The Pennsylvania Constitution reads as follows:
§ 21.  Right to bear arms.
"The right of the citizens to bear arms in defense of themselves and the State shall not be questioned."

Our legislation will preserve that right and curb federal attempts to infringe upon it.

Co-sponsors from last session include Senators AUMENT, BARTOLOTTA, BROOKS, GEBHARD, HUTCHINSON, PENNYCUICK, PHILLIPS-HILL, ROTHMAN, STEFANO, J. WARD and YAW.

Please consider co-sponsoring this important piece of legislation to protect our Constitutionally protected rights to keep and bear arms.
