Subject: | LBFC Study on the Effects of Act 12 of 2016 (Sales of Water & Sewer Systems to Private Companies) and Rate Increases |
I will be reintroducing a Resolution to direct the Legislative Budget and Finance Committee to conduct a study on the effects of Act 12 of 2016 (valuation of an acquired water or wastewater system). This was SR 141 in the 2023-2024 legislative session, cosponsored by Senators Schwank, Cappelletti and Comitta. Since this Act took effect, Pennsylvania has seen an abundance of public systems sold to private companies – whether the system was struggling or not. There have also been a number of rate increases in this timeframe as well, particularly systems that were bought by private companies. This study will look at the acquisitions that have taken place since Act 12 of 2016 has taken effect, and the rate increases for these particular systems for both before the acquisition took place, and in the years following the acquisition. This will give us a comparison as to the effects of this Act on our constituents and the rates they pay. The intent of this Resolution is to protect the ratepayers by ensuring transparency in the outcome of Act 12. I hope you will join me in cosponsoring this important Resolution.
