AN ACT
Amending Title 34 (Game) of the Pennsylvania Consolidated
Statutes, in fiscal affairs, further providing for
establishment and use of Game Fund and for appropriation and
audit of moneys.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 522(a) and (c) of Title 34 of the
Pennsylvania Consolidated Statutes are amended to read:

the Pennsylvania Consolidated Statutes are amended to read:
§ 521. Establishment and use of Game Fund.
(a) General rule.--Except as otherwise provided in this
title, all fees, royalties, fines, penalties and other moneys
paid, received, recovered and collected under the provisions of
this title shall be placed in a separate fund by the State
Treasurer to be known as the Game Fund and shall be used solely
by the commission for any contingent, incidental or other
expenses of any kind or description reasonably necessary in
carrying on the work of the commission, including, but not

limited to, the purchase of land, the costs of activities [for]
directly related to the promotion of public interest in
recreational hunting and furtaking, nongame species, endangered
or threatened species and all other game or wildlife in this
Commonwealth and administration of this title[.] based on the
needs and best interest of the sportsmen and sportswomen of this
Commonwealth. Money in the Game Fund may not be transferred by
an entity other than the commission and may not be transferred
for a use not consistent with this subsection.

§ 522. Appropriation and audit of moneys.
(a) Appropriation.--
(1) Subject to an annual review and recommendations
under subsection (b), all moneys in the Game Fund are hereby
appropriated to the commission and may be expended only for
the purposes authorized under this title. This paragraph
expires June 30, 2025.
(2) Beginning January 1, 2025, the commission shall
prepare and annually submit to the chair of the
Appropriations Committee of the Senate and the chair of the
Appropriations Committee of the House of Representatives the
information required under subsection (b)(2) and an analysis
of and requests and recommendations regarding the itemized
budget of amounts to be appropriated from the Game Fund.

(c) Expenditures from Game Fund.--
(1) After review under subsection (a), the commission
shall submit to the Governor, for approval or disapproval,
estimates of the amount of moneys to be expended from the
Game Fund. The State Treasurer shall not honor any

requisition for expenditure of any moneys in excess of the
amount approved by the Governor. Moneys in the Game Fund
shall be paid out upon warrant of the State Treasurer drawn
after requisition by the director of the commission. This
paragraph expires June 30, 2025.
(2) Beginning with the 2025-2026 fiscal year, moneys in
the Game Fund shall be paid out upon appropriation by the
General Assembly and, after requisition by the director of
the commission, warrant of the State Treasurer.
Section 2. This act shall take effect immediately. as
follows:
(1) The amendment of 34 Pa.C.S. § 521(a) shall take
effect in 60 days.
(2) The remainder of this act shall take effect
immediately.
