AN ACT
Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
act relating to the public school system, including certain
provisions applicable as well to private and parochial
schools; amending, revising, consolidating and changing the
laws relating thereto," in the State System of Higher
Education, further providing for Board of Governors.

provisions applicable as well to private and parochial
schools; amending, revising, consolidating and changing the
laws relating thereto," in the State System of Higher
Education, further providing for Board of Governors and for
powers and duties of the Board of Governors.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 2004-A(a)(7) of the act of March 10, 1949
(P.L.30, No.14), known as the Public School Code of 1949, is
amended to read:
Section 2004-A. Board of Governors.--(a) The system shall
be governed and all of its corporate powers exercised by the
Board of Governors, which shall consist of twenty (20) members
to be appointed as follows:

(7) Eleven (11) members shall be appointed by the Governor
with the advice and consent of the Senate, of which:
(i) six (6) members shall be selected from the residents of
this Commonwealth [and five (5)];
(ii) three (3) members shall be selected from trustees of
constituent institutions, except that no more than one trustee
may represent a constituent institution[.];
(iii) one (1) member must be a current or retired member of
the State system bargaining unit of the American Federation of
State, County and Municipal Employees and selected by the
governing board of the bargaining unit; and
(iv) one (1) member must be a current or retired member of
the State system bargaining unit of the Association of
Pennsylvania State College and University Faculties and selected
by the governing board of the bargaining unit.
A member appointed under this paragraph must have expertise or
substantial experience in at least one area, including
postsecondary education, finance, business, nonprofit
management, law or public administration.

Section 2. This act shall take effect immediately.
Section 1. Section 2004-A(a) introductory paragraph of the
act of March 10, 1949 (P.L.30, No.14), known as the Public
School Code of 1949, is amended and the subsection is amended by
adding paragraphs to read:
Section 2004-A. Board of Governors.--(a) The system shall
be governed and all of its corporate powers exercised by the
Board of Governors, which shall consist of [twenty (20)] twenty-
two (22) members to be appointed as follows:

(9) One (1) member shall be a nonfaculty employe at a
constituent institution and appointed by the board under section
2006-A(a)(17), with the advice and consent of the institution
presidents. The member shall serve as a nonvoting member of the
board. The member shall be included in all meetings of the
board, except for executive sessions and when a clear conflict
of interest is identified by the chairperson of the board.
(10) One (1) member shall be a faculty member at a
constituent institution appointed by the board under section
2006-A(a)(17) with the advice and consent of the Faculty
Council. The member shall serve as a nonvoting member of the
board. The member shall be included in all meetings of the
board, except for executive sessions and when a clear conflict
of interest is identified by the chairperson of the board.

Section 2. Section 2006-A(a)(17) of the act is amended to
read:
Section 2006-A. Powers and Duties of the Board of
Governors.--(a) The Board of Governors shall have overall
responsibility for planning and coordinating the development and
operation of the system. The powers and duties of the Board of
Governors shall be:

(17) To appoint student, faculty and nonfaculty members to
the board and councils.

Section 3. This act shall take effect in 60 days.
