Amend Bill, page 19, by inserting between lines 3 and 4
Section 811-C. Exceptions to requirements.
(a) Authorization.--The department shall permit a hospital
to request an exception to the requirements under this chapter.
(b) Form.--A request under subsection (a) shall identify
with specificity the reasons for which the exception is sought.
(c) Consideration.--In considering a request under
subsection (a), the department shall grant the exception if the
department determines that the health and safety of patients
will not be compromised in granting the exception. The
department may not deny the request solely because a hospital
has requested an exception to the requirements under section
802-C.
(d) Determination.--The department shall issue a written
determination to a hospital requesting an exception under
subsection (a) within 60 days of receipt of the request stating
the reasons for the determination.
