AMENDMENTS TO HOUSE BILL NO. 2226

Amend Bill, page 5, lines 27 through 30; page 6, lines 1
through 6; by striking out all of said lines on said pages and
inserting
"Technology business." A business that has its headquarters
or base of operations in this Commonwealth and either:
(1) Meets all of the following:
(i) owns, has filed for or has a valid license to
use protected, proprietary intellectual property; and
(ii) employs a combination of highly educated or
trained managers and workers, or both, employed in this
Commonwealth who use sophisticated scientific research
service or production equipment, processes or knowledge
to discover, develop, test, transfer or manufacture a
product or service.
(2) Meets all of the following:
(i) is majority-owned by a Pennsylvania resident who
resides in a geographic area in which there are trigger
projects with permits, authorizations or approvals
analyzed by the Department of Environmental Protection;
(ii) is affiliated with any public, State-related
institution or other entity that has received State
funding within the prior two fiscal years that provides
technology-related programming or initiatives; and
(iii) has accrued net losses that would otherwise be
allowable as a deduction from taxable income under
section 401(3) that are related to environmental
remediation, environmental resiliency, energy efficiency,
energy conservation or solar, wind or geothermal energy
production.
