        REFERRED TO COMMITTEE ON RULES, FEBRUARY 3, 1999

                                  A RESOLUTION

     1  Instructing the Education Committee to conduct a comprehensive
     2     review of the Public School Code of 1949 in order to bring it
     3     up to date by deleting obsolete provisions and irrelevant
     4     language.

     5     WHEREAS, The Public School Code was codified in 1949 and has
     6  been amended on a piecemeal basis since then; and
     7     WHEREAS, The Public School Code of 1949 abounds with obsolete
     8  and irrelevant language which has never been corrected or
     9  replaced; and
    10     WHEREAS, The Public School Code of 1949 long ago reached the
    11  point where many parts of it are inconsistent with regulations
    12  that have been promulgated by the State Board of Education; and
    13     WHEREAS, During many recent discussions in the House of
    14  Representatives about charter schools, arguments were presented
    15  that charter schools were a way to bypass burdensome regulations
    16  promulgated under the Public School Code of 1949; and

     1     WHEREAS, Updating the Public School Code of 1949 would also
     2  serve as a first step toward scrutinizing the matter of
     3  unnecessary, unfunded and underfunded State mandates imposed on
     4  school districts; therefore be it
     5     RESOLVED, That the Education Committee conduct a thorough,
     6  comprehensive review of the Public School Code of 1949 solely
     7  for the purpose of updating it and making it relevant to the eve
     8  of the 21st century; and be it further
     9     RESOLVED, That the Education Committee shall report to the
    10  House of Representatives on its findings and recommendations by
    11  November 16, 2000.
