        AS REPORTED FROM COMMITTEE ON EDUCATION, HOUSE OF
           REPRESENTATIVES, AS AMENDED, MAY 12, 1997

                                     AN ACT

     1  Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
     2     act relating to the public school system, including certain
     3     provisions applicable as well to private and parochial
     4     schools; amending, revising, consolidating and changing the
     5     laws relating thereto," providing for the attendance of
     6     expelled students.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  The act of March 10, 1949 (P.L.30, No.14), known
    10  as the Public School Code of 1949, is amended by adding a
    11  section to read:
    12     Section 1320.  Provisional Enrollment of Transferring
    13  Students.--The receiving school entity may enroll a pupil
    14  transferring from another district SCHOOL ENTITY on a             <--
    15  provisional basis until a certified copy of the pupil's
    16  disciplinary record or sworn statement as required in section


     1  1304-A is received by the school entity. If the disciplinary
     2  record contains a history of misbehavior, the student may be
     3  placed in an alternative program and may be ineligible to
     4  participate in extracurricular activities at the discretion of
     5  the receiving entity. No school entity shall be required to
     6  admit a student who has been expelled from another school entity
     7  into its regular program until the period of expulsion has
     8  expired.
     9     Section 2.  This act shall take effect immediately.
