A RESOLUTION 1 Memorializing Congress to exempt certain senior citizens from 2 participation in the Medicare Catastrophic Coverage Act of 3 1988. 4 WHEREAS, Some senior citizens have chosen to reside in a life 5 care community; and 6 WHEREAS, Some life care communities contract with residents 7 to provide continuing care in all eventualities; and 8 WHEREAS, Residents pay an entrance fee and monthly 9 maintenance fees to insure their continuing care; and 10 WHEREAS, The Medicare Catastrohpic Coverage Act of 1988 11 duplicates coverage these senior citizens have arranged for 12 themselves; and 13 WHEREAS, The legislation was designed to protect elderly and 14 disabled Medicare beneficiaries from overwhelming medical costs; 15 and 16 WHEREAS, Paying twice for the same coverage is not cost 17 effective or fair to these senior citizens; and 18 WHEREAS, This Federal law should permit senior citizens who
1 choose to do so because of other protection to opt out of the 2 coverage; therefore be it 3 RESOLVED, That the House of Representatives of the 4 Commonwealth of Pennsylvania memorialize the Congress of the 5 United States to address the inequity created by the Medicare 6 Catastrophic Coverage Act of 1988 by creating an exemption for 7 certain senior citizens; and be it further 8 RESOLVED, That copies of this resolution be transmitted to 9 the presiding officers of each house of Congress and to each 10 member of Congress from Pennsylvania.
