AN ACT

 

1Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
2Statutes, in inspection of vehicles, further providing for
3inspection by police or Commonwealth personnel; and in
4enforcement, further providing for investigation by police
5officers.

6The General Assembly of the Commonwealth of Pennsylvania
7hereby enacts as follows:

8Section 1.  Sections 4704(a)(2) and 6308(b) of Title 75 of
9the Pennsylvania Consolidated Statutes are amended to read:

10§ 4704.  Inspection by police or Commonwealth personnel.

11(a)  Authority to inspect.--

13(2)  Systematic vehicle inspection programs.--Any
14Pennsylvania State Police officer or qualified Commonwealth
15employee engaged in a systematic vehicle inspection program
16may inspect any vehicle, driver, documents, equipment and
17load to determine whether they meet standards established in
18department regulations. A systematic vehicle inspection 
19program shall not be based on stopping only a particular type 

1of vehicle, such as a passenger car, truck or motorcycle. 
2Notwithstanding this subsection, a program may stop only 
3commercial motor vehicles, as defined in section 1603 
4(relating to definitions).

6§ 6308.  Investigation by police officers.

8(b)  Authority of police officer.--Whenever a police officer
9is engaged in a systematic program of checking vehicles or
10drivers or has reasonable suspicion that a violation of this
11title is occurring or has occurred, he may stop a vehicle, upon
12request or signal, for the purpose of checking the vehicle's
13registration, proof of financial responsibility, vehicle
14identification number or engine number or the driver's license,
15or to secure such other information as the officer may
16reasonably believe to be necessary to enforce the provisions of
17this title. A systematic program of checking vehicles or drivers 
18shall not be based on stopping only a particular type of 
19vehicle, such as a passenger car, truck or motorcycle. 
20Notwithstanding this subsection, a program may stop only 
21commercial motor vehicles, as defined in section 1603 (relating 
22to definitions).

24Section 2.  This act shall take effect in 60 days.
