AN ACT 1 Amending Title 18 (Crimes and Offenses) of the Pennsylvania 2 Consolidated Statutes, further providing for offense of 3 scattering rubbish. 4 The General Assembly of the Commonwealth of Pennsylvania 5 hereby enacts as follows: 6 Section 1. Section 6501(a)(3) and (b)(5) of Title 18 of the 7 Pennsylvania Consolidated Statutes are amended to read: 8 § 6501. Scattering rubbish. 9 (a) Offense defined.--A person is guilty of an offense if 10 he: 11 * * * 12 (3) is the owner or operator, or an agent of either, of 13 [a trash, garbage or debris collection vehicle, including 14 private automobiles and small trucks, or any other type of 15 vehicles] any vehicle used [to collect or transport] at any 16 time, whether or not for profit in the collection or 17 transportation of any amount of trash, garbage or debris, who
1 knowingly causes to be deposited or deposits the vehicle's 2 load or any part thereof upon any road, street, highway, 3 alley or railroad right-of-way, or upon the land of another 4 or into the waters of this Commonwealth. 5 (b) Penalty.-- 6 * * * 7 (5) Any vehicle, equipment or conveyance, including any 8 private automobile and small truck, used for the 9 transportation or disposal of: 10 (i) trash, garbage or debris exceeding 25 pounds; or 11 (ii) trash, garbage or debris in the commission of a 12 second or subsequent offense under subsection (a)(3); 13 may be deemed contraband and forfeited in accordance with the 14 provisions set forth in this section. 15 * * * 16 Section 2.
