HOUSE BILL

           GOODMAN, MANN, THOMAS, WASHINGTON, WOJNAROSKI AND YOUNGBLOOD,
           FEBRUARY 8, 2005

                                     AN ACT

     1  Amending the act of June 23, 1931 (P.L.932, No.317), entitled
     2     "An act relating to cities of the third class; and amending,
     3     revising, and consolidating the law relating thereto,"
     4     further providing for building inspectors, housing
     5     inspectors, property maintenance inspectors, fire prevention
     6     inspectors, electrical inspectors and plumbing inspectors.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  Section 4132 of the act of June 23, 1931
    10  (P.L.932, No.317), known as The Third Class City Code, reenacted
    11  and amended June 28, 1951 (P.L.662, No.164) and amended December
    12  21, 1998 (P.L.1013, No.135), is amended to read:
    13     Section 4132.  Building Inspectors, Housing Inspectors,
    14  Property Maintenance Inspectors, Fire Prevention Inspectors,
    15  Electrical Inspectors, and Plumbing Inspectors.--Council may
    16  appoint building inspectors, housing inspectors, property
    17  maintenance inspectors, fire prevention inspectors, electrical
    18  inspectors and plumbing inspectors and fix their compensation.
    19  Such inspectors shall have the right to enter upon and inspect


     1  any and all premises at all reasonable hours for the
     2  administration and enforcement of the building ordinance, the
     3  housing ordinance, the property maintenance ordinance, the fire
     4  prevention ordinance, the electrical ordinance and the plumbing
     5  ordinance and shall be considered "law enforcement officers"
     6  within the meaning of the Pennsylvania Rules of Criminal
     7  Procedure for the purpose of instituting summary proceedings by
     8  citation for violation of any statute or ordinance that they are
     9  employed to enforce. Any fees payable to them under the building
    10  ordinance, the housing ordinance, the property maintenance
    11  ordinance, the fire prevention ordinance, the electrical
    12  ordinance and the plumbing ordinance shall be paid by them to
    13  the city treasurer for the use of the city as promptly as may
    14  be.
    15     Section 2.  This act shall take effect in 60 days.
