AN ACT

 

1Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
2Statutes, further providing for driving while operating
3privilege is suspended or revoked.

4The General Assembly of the Commonwealth of Pennsylvania
5hereby enacts as follows:

6Section 1.  Section 1543(b)(1) of Title 75 of the
7Pennsylvania Consolidated Statutes is amended to read:

8§ 1543.  Driving while operating privilege is suspended or
9revoked.

11(b)  Certain offenses.--

12(1)  (i)  A person who drives a motor vehicle on a
13highway or trafficway of this Commonwealth at a time when
14the person's operating privilege is suspended or revoked
15as a condition of acceptance of Accelerated
16Rehabilitative Disposition for a violation of section
173802 (relating to driving under influence of alcohol or
18controlled substance) or the former section 3731, because

1of a violation of section 1547(b)(1) (relating to
2suspension for refusal) or 3802 or former section 3731 or
3is suspended under section 1581 (relating to Driver's
4License Compact) for an offense substantially similar to
5a violation of section 3802 or former section 3731 shall,
6upon conviction, be guilty of a summary offense and shall
7be sentenced to pay a fine of $500 and to undergo
8imprisonment for a period of not less than 60 days nor
9more than 90 days.

10(ii)  A second violation of this paragraph shall
11constitute a misdemeanor of the third degree. Upon
12conviction, the person committing the violation shall be
13sentenced to pay a fine of $1,000 and to undergo
14imprisonment of not less than 90 days and not more than
15six months.

16(iii)  A third or subsequent violation of this
17paragraph shall constitute a misdemeanor of the second
18degree. Upon conviction, the person committing the
19violation shall be sentenced to pay a fine of $2,500 and
20to undergo imprisonment for not less than six months nor
21more than two years.

23Section 2.  This act shall take effect in 60 days.
