HOUSE RESOLUTION

No. 332 Session of 2000


        INTRODUCED BY CAPPABIANCA, CAWLEY, DRUCE, GEIST, HENNESSEY,
           NAILOR, NICKOL, RUBLEY, SCHRODER, SCHULER, SHANER, STABACK
           AND TIGUE, JANUARY 10, 2000

        REFERRED TO COMMITTEE ON RULES, JANUARY 10, 2000

                                  A RESOLUTION

     1  Establishing a select committee to study the appropriate
     2     procedure for expulsion of members.

     3     WHEREAS, There is a lack of a definitive procedure for the
     4  House of Representatives to follow in expulsion of members; and
     5     WHEREAS, This issue is of critical concern to the
     6  constitutional structure and institutional integrity of the
     7  House; therefore be it
     8     RESOLVED, That a Select Committee on Expulsion Procedures be
     9  established, consisting of ten members, five members appointed
    10  by the Majority Leader and five members appointed by the
    11  Minority Leader, with a chairperson appointed by the Speaker of
    12  the House of Representatives; and be it further
    13     RESOLVED, That the committee study the constitutional,
    14  statutory and ethical issues involved in the sanction of
    15  expulsion of a member of the House of Representatives; and be it
    16  further
    17     RESOLVED, That the committee be authorized to hold hearings,


     1  take testimony and make its investigations at such places as it
     2  deems necessary in this Commonwealth; and be it further
     3     RESOLVED, That the committee be authorized to issue subpoenas
     4  under the hand and seal of its chairperson commanding any person
     5  to appear before the committee and to answer questions touching
     6  matters properly being inquired into by the committee and to
     7  produce documents as the committee deems necessary; and be it
     8  further
     9     RESOLVED, That the subpoenas be able to be served upon any
    10  person and have the same effect as subpoenas issued out of the
    11  courts of this Commonwealth and that any person that
    12  intentionally neglects or refuses to testify before the
    13  committee or to produce documents be subject to the penalties
    14  provided by the laws of this Commonwealth in such case; and be
    15  it further
    16     RESOLVED, That each member of the committee have power to
    17  administer oaths and affirmations to witnesses appearing before
    18  the committee; and be it further
    19     RESOLVED, That the committee, by November 30, 2000, make a
    20  report to the House of Representatives, with recommendations for
    21  full procedure on expulsion set forth in the rules of the House.
