AN ACT

 

1Amending Title 42 (Judiciary and Judicial Procedure) of the
2Pennsylvania Consolidated Statutes, in limitation of time,
3further providing for summary offenses involving vehicles.

4The General Assembly of the Commonwealth of Pennsylvania
5hereby enacts as follows:

6Section 1. Section 5553(a) and (d) of Title 42 of the
7Pennsylvania Consolidated Statutes are amended to read:

8§ 5553. Summary offenses involving vehicles.

9(a) General rule.--Except as provided in subsection [(b) or]
10(c) or (d), proceedings for summary offenses under Title 75
11(relating to vehicles) must be commenced within 30 days after
12the commission of the alleged offense or within 30 days after
13the discovery of the commission of the offense or the identity
14of the offender, whichever is later, and not thereafter.

16(d) Local ordinances on overtime parking.--Local ordinances
17pertaining to overtime parking shall be subject to the
18provisions of this section. A municipality may provide, by 

1ordinance, for follow-up notification of an overtime parking 
2violation. The notification shall be by first class mail to the 
3alleged offender and shall occur between 30 and 45 days 
4following the issuance of the parking ticket. When follow-up 
5notification is provided to an alleged offender, the limitation 
6period under subsection (a) shall be extended 30 days.

8Section 2. This act shall take effect in 60 days.
