AN ACT
1 Amending the act of June 3, 1937 (P.L.1333, No.320), entitled
2 "An act concerning elections, including general, municipal,
3 special and primary elections, the nomination of candidates,
4 primary and election expenses and election contests; creating
5 and defining membership of county boards of elections;
6 imposing duties upon the Secretary of the Commonwealth,
7 courts, county boards of elections, county commissioners;
8 imposing penalties for violation of the act, and codifying,
9 revising and consolidating the laws relating thereto; and
10 repealing certain acts and parts of acts relating to
11 elections," further providing for compensation of election
12 officers.
13 The General Assembly of the Commonwealth of Pennsylvania
14 hereby enacts as follows:
15 Section 1. Section 412.1(a) of the act of June 3, 1937
16 (P.L.1333, No.320), known as the Pennsylvania Election Code,
17 added May 5, 1982 (P.L.374, No.108), is amended and the section
18 is amended by adding a subsection to read:
19 Section 412.1. Compensation of Election Officers.--(a) In
20 all counties except in counties of the second class, the
21 compensation of judges, inspectors, clerks and machine
22 inspectors shall be fixed by the county board of elections of
1 the county at not less than the following: judge of elections, 2 forty-five dollars ($45.00); inspectors and clerks, forty 3 dollars ($40.00); and machine operators, forty dollars ($40.00); 4 and not more than the following: judge of elections, seventy 5 dollars ($70.00); inspectors and clerks, sixty-five dollars 6 ($65.00) and machine operators sixty-five dollars ($65.00); for 7 each primary and election. The county board of elections may, in 8 its discretion, establish different per diem rates within the 9 above mentioned minima and maxima based on the number of votes 10 cast for the following groups: 150 votes or less, 151 to 300 11 votes, 301 to 500 votes, 501 to 750 votes, 751 and over. 12 (a.1) In counties of the second class, the compensation of 13 judges, inspectors, clerks and machine inspectors shall be fixed 14 by the county board of elections of the county at not less than 15 the following: judge of elections, forty-five dollars ($45.00); 16 inspectors and clerks, forty dollars ($40.00); and machine 17 operators, forty dollars ($40.00); and not more than the 18 following: judge of elections, ninety dollars ($90.00); 19 inspectors and clerks, eighty-five dollars ($85.00); and machine 20 operators sixty-five dollars ($65.00); for each primary and 21 election. The county board of elections may, in its discretion, 22 establish different per diem rates within the above mentioned 23 minima and maxima based on the number of votes cast for the 24 following groups: 150 votes or less, 151 to 300 votes, 301 to 25 500 votes, 501 to 750 votes, 751 and over. 26 * * * 27 Section 2.
