AN ACT

 

1Amending the act of September 30, 1983 (P.L.160, No.39),
2entitled "An act establishing salaries and compensation of
3certain public officials including justices and judges of
4Statewide courts, judges of courts of common pleas, judges of
5the Philadelphia Municipal Court, judges of the Philadelphia
6Traffic Court, district justices and the Governor, the
7Lieutenant Governor, the State Treasurer, the Auditor
8General, the Attorney General and certain other State
9officers and the salary and certain expenses of the members
10of the General Assembly; and repealing certain inconsistent
11acts," providing for limitations on certain additional
12expenses of the General Assembly.

13The General Assembly of the Commonwealth of Pennsylvania
14hereby enacts as follows:

15Section 1. The act of September 30, 1983 (P.L.160, No.39),
16known as the Public Official Compensation Law, is amended by
17adding a section to read:

18Section 5.3. Limitations on certain additional expenses of the
19General Assembly.

20(a) Prohibition on per diem payments.--Any payment made to a
21member of the General Assembly that is a per diem payment, or
22would be considered a per diem payment under the Internal

1Revenue Code of 1986 (Public Law 99-514, 26 U.S.C. § 1 et seq.),
2for days of service shall be prohibited. Only actual expenses
3shall be reimbursable to an individual member upon the receipt
4of documentation of the expense.

5(b) Limitations.--This section shall only apply to payments
6made for individual days of service. This section shall not
7impact any other form of compensation including salary, benefits
8or reimbursed expenses.

9Section 2. All rules and regulations inconsistent with this
10act are abrogated insofar as the rule or regulation is
11inconsistent with the act.

12Section 3. This act shall take effect in 60 days.
