AN ACT 1 Amending Title 75 (Vehicles) of the Pennsylvania Consolidated 2 Statutes, providing for a prohibition against leaving an 3 unattended child in a school bus. 4 The General Assembly of the Commonwealth of Pennsylvania 5 hereby enacts as follows: 6 Section 1. Section 3701.1 of Title 75 of the Pennsylvania 7 Consolidated Statutes is amended to read: 8 § 3701.1. Leaving an unattended child in a motor vehicle. 9 (a) General rule.--A person driving or in charge of a motor 10 vehicle may not permit a child under six years of age to remain 11 unattended in the vehicle when the motor vehicle is out of the 12 person's sight and under circumstances which endanger the 13 health, safety or welfare of the child. 14 (a.1) Applicability.--This section shall apply to the 15 highways and trafficways of this Commonwealth and, for the 16 purposes of this section only, the term "trafficways" shall
1 include, but not be limited to, parking lots. This section does 2 not apply to a person driving a school bus. 3 (b) Penalty.--A person who violates this section commits a 4 summary offense. 5 Section 2. Title 75 is amended by adding a section to read: 6 § 3701.2. Leaving unattended children in a school bus. 7 (a) General rule.--A person driving a school bus may not 8 permit a child of school age to remain unattended in the school 9 bus when the bus is out of the driver's sight and under 10 circumstances which endanger the health, safety or welfare of 11 the child. 12 (b) Applicability.--This section shall apply to the highways 13 and trafficways of this Commonwealth and, for the purposes of 14 this section only, the term "trafficways" shall include, but not 15 be limited to, parking lots. 16 (c) Penalty.--A person who violates this section commits a 17 summary offense. The court shall order the operating privilege 18 of the person suspended for 90 days upon conviction of a 19 violation of this section.
