AN ACT
1 Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
2 Statutes, further providing for accident reports.
3 The General Assembly of the Commonwealth of Pennsylvania
4 hereby enacts as follows:
5 Section 1. Section 3751 of Title 75 of the Pennsylvania
6 Consolidated Statutes, amended November 30, 2004 (P.L.1667,
7 No.211), is amended to read:
8 § 3751. Reports by police.
9 (a) General rule.--Every police department that investigates
10 a vehicle accident for which a report must be made as required
11 in this subchapter and prepares a written report as a result of
12 an investigation either at the time and at the scene of the
13 accident or thereafter by interviewing the participants or
14 witnesses shall, within [15] three days of the accident, forward
15 an initial written report of the accident to the department. If
16 the initial report is not complete, a supplemental report shall
17 be submitted at a later date.
1 (b) Furnishing copies of report.-- 2 (1) Police departments shall, upon request within three 3 days of the accident, furnish a certified copy of the full 4 report of the police investigation of any vehicle accident to 5 any person involved in the accident, his attorney or insurer, 6 and to the Federal Government, branches of the military 7 service, Commonwealth agencies, and to officials of political 8 subdivisions and to agencies of other states and nations and 9 their political subdivisions. 10 (2) Except as provided in paragraph (3), the cost of 11 furnishing a copy of a report under this subsection shall not 12 exceed $15. 13 (3) In a city of the first class, the cost of furnishing 14 a copy of a report under this subsection shall not exceed 15 $25. 16 (4) The copy of the report shall not be admissible as 17 evidence in any action for damages or criminal proceedings 18 arising out of a motor vehicle accident. 19 (5) Police departments may refuse to furnish the 20 complete copy of investigation of the vehicle accident 21 whenever there are criminal charges pending against any 22 persons involved in the vehicle accident unless the 23 Pennsylvania Rules of Criminal Procedure require the 24 production of the documents. 25 Section 2.
