AN ACT 1 Imposing a fee upon persons mining or removing coal; and placing 2 restrictions upon the expenditure of certain moneys. 3 The General Assembly of the Commonwealth of Pennsylvania 4 hereby enacts as follows: 5 Section 1. Imposition of fee. 6 There is hereby imposed a fee of 50¢ on each ton of coal 7 mined or removed. The person who mines or removes the coal shall 8 be responsible for payment. This fee shall be paid to the 9 Department of Environmental Resources. The department shall 10 impose fees based on the mining records of such persons. 11 Section 2. Establishment of fund. 12 All fees imposed and collected by the Department of 13 Environmental Resources under section 1 shall be placed in a 14 separate fund. The moneys in the fund shall be given to the 15 city, borough, town or township from which the coal was mined or 16 removed. This shall be done annually. 17 Section 3. Use of funds.
1 The funds given to any city, borough, town or township 2 pursuant to section 2 may be used only for environmental cleanup 3 of conditions and damages that are a result of the coal mining 4 or removal and shall include, but not be limited to, air and 5 water pollution. Any other use of these funds is prohibited and 6 shall result in a forfeiture of any such funds to the Department 7 of Environmental Resources. 8 Section 4.
