AN ACT 1 Amending the act of March 19, 1951 (P.L.28, No.4), entitled "An 2 act relating to the civil defense of this State and its 3 coordination with national defense; providing for the 4 establishment of a State Council of Civil Defense, local and 5 district councils of civil defense, Mobile Support Units; 6 prescribing the powers, duties and immunities thereof and of 7 their personnel; authorizing mutual aid compacts and 8 providing penalties," by further providing for compensation 9 for accidental injury in certain instances. 10 The General Assembly of the Commonwealth of Pennsylvania 11 hereby enacts as follows: 12 Section 1. Section 12.1, act of March 19, 1951 (P.L.28, 13 No.4), known as the "State Council of Civil Defense Act of 14 1951," added September 3, 1955 (P.L.553, No.135), is amended to 15 read: 16 Section 12.1. Compensation for Accidental Injury.--All duly 17 enrolled civil defense volunteers who are not eligible to 18 receive benefits under the Workmen's Compensation Law shall be 19 deemed to be employes of the Council, and shall be entitled, 20 except during a state of war or period of armed conflict within 21 the continental limits of the United States, to the [following]
1 benefits provided by the provisions of section 601, act of June 2 2, 1915 (P.L.736, No.338), known as "The Pennsylvania Workmen's 3 Compensation Act," relating to injuries sustained while actually 4 engaged in civil defense or disaster training activities or in 5 or en route to and from civil defense or disaster tests or 6 operations authorized by the Council and carried out in 7 accordance with rules and orders promulgated and adopted by the 8 Council. 9 [(a) A sum of fifteen hundred dollars ($1500) for accidental 10 injury directly causing or leading to death; 11 (b) A sum not to exceed seven hundred fifty dollars ($750) 12 for reimbursement for medical and hospital expenses associated 13 with accidental injury; and 14 (c) Weekly payments of twenty-five dollars ($25), beginning 15 on the eighth day of disability and continuing for not more than 16 twenty-six weeks, for disability directly arising from 17 accidental injury rendering the individual totally incapable of 18 following his normal gainful pursuits.] 19 All benefits hereby authorized shall be paid out of funds 20 appropriated to the Council. Payments shall be made on the basis 21 of claims submitted to the Council through the Bureau of 22 Workmen's Compensation of the Department of Labor and Industry 23 in accordance with rules and orders promulgated and adopted by 24 the Council. 25 Section 2.
