AN ACT 1 Amending the act of July 10, 1981 (P.L.214, No.67), entitled "An 2 act relating to the lawful conduct of bingo, prescribing 3 penalties and making a repeal," licensing and regulating 4 bingo promoters. 5 The General Assembly of the Commonwealth of Pennsylvania 6 hereby enacts as follows: 7 Section 1. Section 3 of the act of July 10, 1981 (P.L.214, 8 No.67), known as the Bingo Law, is amended by adding a 9 definition to read: 10 Section 3. Definitions. 11 The following words and phrases when used in this act shall 12 have, unless the context clearly indicates otherwise, the 13 meanings given to them in this section: 14 * * * 15 "Bingo promoter." An individual or business organization 16 that for profit promotes and/or operates bingo games for 17 entities licensed under this act. 18 * * *
1 Section 2. The act is amended by adding a section to read: 2 Section 5.1. Licensing bingo promoters. 3 (a) License required.--All bingo promoters operating within 4 this Commonwealth shall be licensed. Each bingo promoter shall 5 apply to the licensing authority on a form prescribed by the 6 Secretary of the Commonwealth. 7 (b) Fee.--The licensing fee for bingo promoters shall be 8 $200 annually. 9 (c) Profits.--Bingo promoter profits shall not exceed 25% of 10 the gross daily receipts of the games promoted. 11 (d) Audit reports.--On an annual basis each bingo promoter 12 shall submit to the licensing authority and the Auditor General 13 certified reports relating to its or his bingo promotion 14 business activities within this Commonwealth. 15 Section 3. Section 7(b) of the act, amended December 15, 16 1982 (P.L.1299, No.293), is amended to read: 17 Section 7. Penalty. 18 * * * 19 (b) Misdemeanor.--Any person who conducts or assists in the 20 conducting of bingo in violation of the provisions of this act, 21 is guilty of a misdemeanor of the first degree. Any bingo 22 promoter who violates this act commits a misdemeanor of the 23 first degree. Any person who permits the conduct of bingo on the 24 same premises, owned by him or leased to him, on more than five 25 days in any one week or by more than one association in any 26 calendar day, except for bingo being played at an exposition, 27 carnival or fair, is guilty of a misdemeanor of the first 28 degree. 29 Section 4.
