AN ACT

 

1Amending Title 4 (Amusements) of the Pennsylvania Consolidated
2Statutes, further providing for collection of fees and fines
3and for slot machine licensee deposits; and providing for
4Intellectual Disabilities and Autism Waiting List Account.

5The General Assembly of the Commonwealth of Pennsylvania
6hereby enacts as follows:

7Section 1. Section 1208 of Title 4 of the Pennsylvania
8Consolidated Statutes is amended by adding a paragraph to read:

9§ 1208. Collection of fees and fines.

10The board has the following powers and duties:

12(3) To require each slot machine licensee to collect a
13$2 per-patron admission fee which shall be transmitted weekly
14by the slot machine licensee to the State Treasurer for
15deposit into the slot machine licensee's account established
16under section 1401 (relating to slot machine licensee
17deposits).

18Section 2. Section 1401 of Title 4 is amended by adding a
19subsection to read:

1§ 1401. Slot machine licensee deposits.

3(e) Transfer.--The State Treasurer shall, on a monthly
4basis, transfer the admission fee established under section
51208(3) (relating to collection of fees and fines) into the
6Intellectual Disabilities and Autism Waiting List Account
7pursuant to section 1410 (relating to Intellectual Disabilities
8and Autism Waiting List Account).

9Section 3. Title 4 is amended by adding a section to read:

10§ 1410. Intellectual Disabilities and Autism Waiting List
11Account.

12(a) Fund established.--There is established in the State
13Treasury a special account to be known as the Intellectual
14Disabilities and Autism Waiting List Account, which shall
15receive money from the admission fee established under section
161208(3) (relating to collection of fees and fines) and any other
17money from any source designated for deposit in the Intellectual
18Disabilities and Autism Waiting List Account.

19(b) Use of money.--The admission fee established under
20section 1208(3) shall be deposited into the Intellectual
21Disabilities and Autism Waiting List Account. The money in the
22Intellectual Disabilities and Autism Waiting List Account is
23appropriated, upon approval of the Governor, to the Department
24of Public Welfare for the purposes set forth in subsections (d)
25and (e).

26(c) Investment.--All earnings received from the investment
27or deposit of the moneys in the Intellectual Disabilities and
28Autism Waiting List Account shall be paid into the account for
29the purposes authorized by this section.

30(d) Certain transfer prohibited.--Any unexpended moneys and

1any interest earned on the money in the Intellectual
2Disabilities and Autism Waiting List Account may not be
3transferred or revert to the General Fund, but shall remain in
4the respective account to be used by the department for the
5purposes specified in this section.

6(e) Limitations.--

7(1) Any funds in the Intellectual Disabilities and
8Autism Waiting List Account may not supplant resources for
9existing community resources.

10(2) Any funds in the Intellectual Disabilities and
11Autism Waiting List Account shall be used in accordance with
12consumer-centered planning.

13(3) Any remaining funds after meeting needs identified
14in paragraph (2) shall be used for one-time costs associated
15with the community intellectual disabilities and autism
16services system.

17(f) Definitions.---For the purposes of this section, the
18term "Intellectual Disabilities and Autism Waiting List Account"
19shall mean the Intellectual Disabilities and Autism Waiting List
20Account established in this section.

21Section 4. This act shall take effect in 60 days.
