A RESOLUTION 1 Urging the Congress of the United States to repeal the REAL ID 2 Act of 2005 and to restore section 7212 of the Intelligence 3 Reform and Terrorism Prevention Act of 2004. 4 WHEREAS, The Intergovernmental Affairs Committee has hosted a 5 series of public hearings throughout the Commonwealth of 6 Pennsylvania regarding the REAL ID Act of 2005 (Division B of 7 Public Law 109-13, 119 Stat. 302) and its impact on 8 Pennsylvania; and 9 WHEREAS, The public hearings were held in Erie, Harrisburg, 10 Philadelphia, Pittsburgh, and Scranton to ensure that citizens 11 had the opportunity to be heard and informed of the impact that 12 complying with the REAL ID Act of 2005 will have on the 13 Commonwealth of Pennsylvania; and 14 WHEREAS, The public hearings provided expert testimony from 15 the Pennsylvania Department of Transportation, the Department of 16 Homeland Security, the American Civil Liberties Union, the 17 National Conference of State Legislatures and the Coalition for 18 A Secure Driver's License; and <--
1 WHEREAS, The concerns raised during the public hearings were 2 that the REAL ID Act of 2005 remains a costly, unfunded mandate 3 for the Commonwealth of Pennsylvania, provides insufficient 4 funding from the Federal Government and may infringe on privacy 5 and religious freedom rights; and 6 WHEREAS, According to THE MINIMUM STANDARDS CONTAINED IN the <-- 7 Intelligence Reform and Terrorism Prevention Act of 2004 (Public 8 Law 108-458, 118 Stat. 3638), minimum standards do WOULD not <-- 9 conflict or interfere with the Commonwealth of Pennsylvania's 10 enforcement and regulation of drivers' licenses and 11 identification cards; and 12 WHEREAS, The concerns citizens raised regarding the REAL ID 13 Act of 2005 would be adequately addressed with the passage of 14 United States Senate Bill 717 (2007); therefore be it 15 RESOLVED, That the House of Representatives of the 16 Commonwealth of Pennsylvania urge the Congress of the United 17 States to pass United States Senate Bill 717 (2007), effectively 18 restoring section 7212 of the Intelligence Reform and Terrorism 19 Prevention Act of 2004 (Public Law 108-458, 118 Stat. 3827); and 20 be it further 21 RESOLVED, That copies of this resolution be transmitted to 22 the presiding officers of each house of Congress of the United 23 States and to each member of Congress from the Commonwealth of 24 Pennsylvania; and be it further 25 RESOLVED, That a copy of this resolution be transmitted to 26 the Honorable Daniel K. Akaka, United States Senator from 27 Hawaii; and be it further 28 RESOLVED, That a copy of this resolution be transmitted to 29 the National Conference of State Legislatures.
