AN ACT 1 Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An 2 act relating to the public school system, including certain 3 provisions applicable as well to private and parochial 4 schools; amending, revising, consolidating and changing the 5 laws relating thereto," authorizing the collection of an 6 additional fee at State universities under certain 7 conditions. 8 The General Assembly of the Commonwealth of Pennsylvania 9 hereby enacts as follows: 10 Section 1. Section 2011-A of the act of March 10, 1949 11 (P.L.30, No.14), known as the Public School Code of 1949, is 12 amended by adding a subsection to read: 13 Section 2011-A. Rental Fees and Other Charges.--* * * 14 (c) At all universities of the State System of Higher 15 Education where a majority of students voting every two (2) 16 years in a campus-wide referendum vote for the voluntary 17 collection of a waivable fee of three dollars ($3) per semester 18 for the Commonwealth Association of Students (CAS), such fee 19 shall be collected by the institution. The institution shall not
1 impose sanctions against students for nonpayment of the fee. 2 This fee shall appear on a student's tuition bill as a separate 3 item AND SHALL BE ACCOMPANIED BY A NOTICE THAT THE FEE IS <-- 4 VOLUNTARY AND WAIVABLE. Each institution's participation in the 5 agreement is that of a collecting agent and shall not be 6 construed as approval by the institution of any action taken or 7 proposed by the Commonwealth Association of Students. A five per 8 centum (5%) collecting agent's fee shall be retained by the 9 institution for processing and handling. An independent annual 10 audit of the Commonwealth Association of Students shall be 11 submitted to the institutional presidents and the Board of 12 Governors of the State System of Higher Education. 13 Section 2.
