        AS REPORTED FROM COMMITTEE ON URBAN AFFAIRS, HOUSE OF
           REPRESENTATIVES, AS AMENDED, NOVEMBER 24, 2003

                                     AN ACT

     1  Amending the act of June 23, 1931 (P.L.932, No.317), entitled
     2     "An act relating to cities of the third class; and amending,
     3     revising, and consolidating the law relating thereto,"
     4     further providing for residency requirements for vacancy
     5     appointments.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  The act of June 23, 1931 (P.L.932, No.317), known
     9  as The Third Class City Code, reenacted and amended June 28,
    10  1951 (P.L.662, No.164), is amended by adding a section to read:
    11     Section 803.  Residency Requirement.--(A)  No person shall be  <--
    12  appointed to fill a vacancy in an elected city office IN ANY      <--
    13  CITY OF THE THIRD CLASS unless he or she has resided within the
    14  city continuously for at least one year immediately prior to his
    15  or her appointment.
    16     (B)  AS USED IN THIS SECTION, THE TERM "CITY" SHALL MEAN A     <--
    17  CITY OF THE THIRD CLASS OPERATING UNDER THIS ACT, AN OPTIONAL
    18  CHARTER ADOPTED UNDER THE ACT OF JULY 15, 1957 (P.L.901,

     1  NO.399), KNOWN AS THE "OPTIONAL THIRD CLASS CITY CHARTER LAW,"
     2  OR A HOME RULE CHARTER OR AN OPTIONAL PLAN ADOPTED UNDER 53
     3  PA.C.S. PT. III, SUBPT. E (RELATING TO HOME RULE AND OPTIONAL
     4  PLAN GOVERNMENT).
     5     SECTION 2.  ALL ACTS AND PARTS OF ACTS ARE REPEALED INSOFAR
     6  AS THEY ARE INCONSISTENT WITH THIS ACT.
     7     Section 2 3.  This act shall take effect in 60 days.           <--
