AN ACT

Amending Title 3 (Agriculture) of the Pennsylvania Consolidated

Statutes, requiring restaurants to display dietary

3

information.

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

6

Section 1.  Title 3 of the Pennsylvania Consolidated Statutes

7

is amended by adding a chapter to read:

§ 6601.  Scope of chapter.

This chapter provides for the display by restaurants of

16

dietary information.

§ 6602.  Definitions.

The following words and phrases when used in this chapter

shall have the meanings given to them in this section unless the

2

context clearly indicates otherwise:

3

"Restaurant."  A food establishment licensed under 7 Pa. Code

4

Ch. 78 (relating to food establishments) that is identified with

5

a restaurant chain having 20 or more locations under the same

6

name nationally regardless of the type of ownership of the

7

restaurant locations.

§ 6603.  Requirements.

9

A restaurant shall provide dietary information for all food

10

and drink items sold in its establishment as follows:

11

(1)  Caloric information shall be provided on menu boards

12

in restaurants in which menu boards are displayed. The size,

13

arrangement and typeface of the caloric information shall be

14

similar to and as easy to read as other menu board

15

information, and the nutrition information shall be displayed

16

adjacent to the listing of the food item.

17

(2)  The nutrition information shall be provided on menus

18

in restaurants in which menus are used. The size, arrangement

19

and typeface of the nutrition information shall be similar in

20

size and typeface to other information about each menu item.

The nutrition information shall be similar to the categories

22

of nutrition information provided on packaged foods sold in

23

grocery stores and shall be displayed adjacent to the listing

24

of the food item.

(3)  The nutrition information shall be provided on

26

wrappers and boxes used to deliver particular items of food

27

and drink to customers. The size, arrangement and typeface of

28

the nutrition information shall be similar to that of

29

nutrition information provided on packaged foods sold in

30

grocery stores.

(4)  Restaurants without menus shall display menu boards

2

on the walls. At least one menu board shall be readable from

3

12 feet away from each entrance. The menu board shall meet

4

the requirements of paragraph (1) and contain the information

5

specified in paragraphs (2) and (3).

Section 2.  This act shall take effect in 60 days.
