AN ACT 1 Amending the act of May 31, 1933 (P.L.1108, No.272), entitled, 2 as amended, "An act providing for the appointment, promotion, 3 reduction, removal and reinstatement of paid officers, 4 firemen and employes of fire departments and of fire alarm 5 operators and fire box inspectors in the bureaus of 6 electricity in cities of the third class; defining the powers 7 and duties of civil service commissions for such purposes; 8 and fixing penalties," extending the probationary period for 9 appointments to fire departments. 10 The General Assembly of the Commonwealth of Pennsylvania 11 hereby enacts as follows: 12 Section 1. Section 3, act of May 31, 1933 (P.L.1108, 13 No.272), entitled, as amended, "An act providing for the 14 appointment, promotion, reduction, removal and reinstatement of 15 paid officers, firemen and employes of fire departments and of 16 fire alarm operators and fire box inspectors in the bureaus of 17 electricity in cities of the third class; defining the powers 18 and duties of civil service commissions for such purposes; and 19 fixing penalties," is amended to read: 20 Section 3. The civil service commission in each city shall
1 make rules and regulations providing for examinations for 2 positions in the paid fire department and as fire alarm 3 operators and fire box inspectors in the bureau of electricity 4 in each city, and for appointments to and promotions therein, 5 and for such other matters as are necessary to carry out the 6 purposes of this act. Due notice of the contents of such rules 7 and regulations, and of any modifications thereof, shall be 8 given, by mail, in due season, to appointing officers affected 9 thereby. Such rules and regulations, and modifications thereof, 10 shall also be printed for public distribution. All original 11 appointments to any positions in the fire department and as fire 12 alarm operators and fire box inspectors, within the terms of 13 this act, shall be for a probationary period of [three months] 14 one year SIX MONTHS. DURING SUCH PROBATIONARY PERIOD THE <-- 15 APPOINTEE SHALL NOT BE DENIED ANY RIGHTS OR BENEFITS THAT THE 16 APPOINTEE WOULD OTHERWISE BE ENTITLED TO UNDER ANY COLLECTIVE 17 BARGAINING AGREEMENT. At any time during the probationary 18 period, the appointee may be dismissed for just cause[, in the <-- 19 manner provided in section ten of this act]. If at the close of <-- 20 such probationary term the conduct or capacity of the 21 probationer has not been satisfactory to the appointing officer, 22 the probationer shall be notified, in writing, that he will not 23 receive permanent appointment, whereupon his employment shall 24 cease; otherwise, his retention in the service shall be 25 equivalent to his permanent appointment. 26 Section 2. This act shall take effect in 30 days and shall 27 be applicable to all appointments made on or after the effective 28 date. L16L11RZ/19810H0945B2025 - 2 -
