                                     AN ACT

     1  Amending the act of June 1, 1945 (P.L.1242, No.428), entitled
     2     "An act relating to roads, streets, highways and bridges;
     3     amending, revising, consolidating and changing the laws
     4     administered by the Secretary of Highways and by the
     5     Department of Highways relating thereto," prohibiting the
     6     charging of a fee to certain organizations for the erection
     7     of a sign in a right-of-way.

     8     The General Assembly of the Commonwealth of Pennsylvania
     9  hereby enacts as follows:
    10     Section 1.  Section 425, act of June 1, 1945 (P.L.1242,
    11  No.428), known as the "State Highway Law," is amended to read:
    12     Section 425.  Signs, Banners, etc., across or within Legal
    13  Limits of Highway; Penalty; Abatement.--(a)  It shall be
    14  unlawful to place any sign, banner, or advertising matter of any
    15  kind whatsoever on or across any State highway or on or across
    16  any structure within the legal limits of any State highway
    17  without first having obtained the written consent of the
    18  department. If the applicant is a nonprofit religious or
    19  educational organization no fee shall be charged by the
    20  department for such consent. Any person violating the provisions

     1  of this section shall, upon summary conviction, be sentenced to
     2  pay a fine of not less than four dollars ($4.00) nor more than
     3  twenty dollars ($20.00). All such fines shall be paid into the
     4  county treasury to be used only for the construction or repair
     5  of public roads or highways.
     6     (b)  Any such sign, banner, or advertising matter placed
     7  without the consent of the department is hereby declared to be a
     8  public nuisance, and may be abated by the department with or
     9  without notice to the persons responsible for the placing
    10  thereof.
    11     Section 2.  This act shall take effect immediately.
