1Amending Title 4 (Amusements) of the Pennsylvania Consolidated
2Statutes, in licensees, further providing for Category 1 slot
3machine license, for Category 2 slot machine license and for
4Category 3 slot machine license.

5The General Assembly of the Commonwealth of Pennsylvania
6hereby enacts as follows:

7Section 1. Sections 1302(b), 1304(b)(1) and 1305(b)(1) of
8Title 4 of the Pennsylvania Consolidated Statutes are amended to
9read:

10§ 1302. Category 1 slot machine license.

12(b) Location.--A Category 1 license may only be issued to an
13eligible person authorizing slot machine operations at the
14particular licensed racetrack facility identified in the
15application. No Category 1 licensed facility shall be located
16within 20 linear miles of another Category 1 licensed facility.
17An applicant for a Category 1 license proposing to locate a 
18licensed facility within ten linear miles of a national military
 

1park shall comply with the requirements of 37 Pa.C.S. Ch. 5 
2(relating to historic preservation).

3§ 1304. Category 2 slot machine license.

5(b) Location.--

6(1) Two Category 2 licensed facilities and no more shall
7be located by the board within a city of the first class, and
8one Category 2 licensed facility and no more shall be located
9by the board within a city of the second class. No Category 2
10licensed facility located by the board within a city of the
11first class shall be within ten linear miles of a Category 1
12licensed facility regardless of the municipality where the
13Category 1 licensed facility is located. Except for any
14Category 2 licensed facility located by the board within a
15city of the first class or a city of the second class, no
16Category 2 licensed facility shall be located within 30
17linear miles of any Category 1 licensed facility that has
18conducted over 200 racing days per year for the two calendar
19years immediately preceding the effective date of this part
20and not within 20 linear miles of any other Category 1
21licensed facility. Except for any Category 2 licensed
22facility located by the board within a city of the first
23class, no Category 2 licensed facility shall be located
24within 20 linear miles of another Category 2 licensed
25facility. An applicant for a Category 1 license proposing to 
26locate a licensed facility within ten linear miles of a 
27national military park shall comply with the requirements of 
2837 Pa.C.S. Ch. 5 (relating to historic preservation).

30§ 1305. Category 3 slot machine license.

2(b) Location.--The following shall apply:

3(1) Except as provided in paragraph (1.1), no Category 3
4license shall be located by the board within 15 linear miles
5of another licensed facility. An applicant for a Category 1 
6license proposing to locate a licensed facility within ten 
7linear miles of a national military park shall comply with 
8the requirements of 37 Pa.C.S. Ch. 5 (relating to historic 
9preservation).

11Section 2. This act shall take effect immediately.
