A RESOLUTION
Directing the Joint State Government Commission to conduct a
study of the Commonwealth's statutes and policies regarding
marijuana in light of the legalization of medial marijuana.
WHEREAS, Pennsylvania's Medical Marijuana Act was signed into
law in Pennsylvania on April 17, 2016, which establishes a
medical marijuana program to provide access to medical marijuana
for patients with serious medical conditions; and
WHEREAS, The medical marijuana program does not operate in a
legal vacuum as the effects of inconsistent Commonwealth
statutes and policies can have detrimental impacts on residents
of this Commonwealth unless the related statutes and policies
are not updated to work in tandem with the medical marijuana
program; and
WHEREAS, It is necessary to have a full understanding of
existing marijuana-related statutes and policies so updates can
be made to ensure there are no conflicts with or undermining of
the medical marijuana program; and
WHEREAS, It is critical that residents of this Commonwealth

with serious medical conditions be able to take full advantage
of the medical marijuana program without being hampered by
Commonwealth Statutes and policies which were put in place prior
to the legalization of medical marijuana; and
WHEREAS, In particular the legal use of medical marijuana
should not present an obstacle to gaining employment or to
professional or educational advancement; therefore be it
RESOLVED, That the House of Representatives direct the Joint
State Government Commission to conduct a study of Commonwealth
statutes and policies that relate to marijuana and whether those
statutes and policies work in conjunction with the medical
marijuana program or contradict it; and be it further
RESOLVED, That the Joint State Government Commission provide
recommendations necessary or desirable to address these statute
and policy contradictions; and be it further
RESOLVED, That the Joint State Government Commission report
to the House of Representatives the result of the study and
recommendations regarding the Commonwealth's statutes and
policies regarding marijuana and file the report with the Chief
Clerk of the House of Representatives no later than 365 days
after adoption of this resolution.
