AN ACT 1 Amending the act of August 15, 1961 (P.L.987, No.442), entitled 2 "An act relating to public works contracts; providing for 3 prevailing wages; imposing duties upon the Secretary of Labor 4 and Industry; providing remedies, penalties and repealing 5 existing laws," further providing for definitions; and 6 providing for school district options. 7 The General Assembly of the Commonwealth of Pennsylvania 8 hereby enacts as follows: 9 Section 1. Section 2(4) of the act of August 15, 1961 10 (P.L.987, No.442), known as the Pennsylvania Prevailing Wage 11 Act, is amended to read: 12 Section 2. Definitions.--As used in this act-- 13 * * * 14 (4) "Public body" means [the] any of the following: 15 (i) The Commonwealth [of Pennsylvania, any of its]. 16 (ii) A political [subdivisions, any] subdivision. Except as 17 set forth in section 13.1, this subclause does not include a
1 school district or an authority, agency or instrumentality 2 established by one or more school districts. 3 (iii) An authority created by the General Assembly [of the 4 Commonwealth of Pennsylvania and any]. 5 (iv) An instrumentality or agency of the Commonwealth [of 6 Pennsylvania]. 7 * * * 8 Section 2. The act is amended by adding a section to read: 9 Section 13.1. School District Option.--Notwithstanding any 10 provision of this act, a school district or an authority, agency 11 or instrumentality established by one or more school districts 12 may elect, by resolution, to be a public body and to subject 13 itself to this act. 14 Section 3. All acts and parts of acts are repealed insofar 15 as they are inconsistent with this act. 16 Section 4. This act shall take effect in 60 days. B6L43DMS/20030H1047B1222 - 2 -
