| AN ACT |
| |
1 | Amending the act of May 23, 1945 (P.L.913, No.367), entitled, as |
2 | amended, "An act relating to and regulating the practice of |
3 | the profession of engineering, including civil engineering, |
4 | mechanical engineering, electrical engineering, mining |
5 | engineering and chemical engineering, the profession of land |
6 | surveying and the profession of geology and constituent parts |
7 | and combinations thereof as herein defined; providing for the |
8 | licensing and registration of persons practicing said |
9 | profession, and the certification of engineers-in-training |
10 | and surveyors-in-training, and the suspension and revocation |
11 | of said licenses, registrations and certifications for |
12 | violation of this act; prescribing the powers and duties of |
13 | the State Registration Board for Professional Engineers, Land |
14 | Surveyors and Geologists, the Department of State and the |
15 | courts; prescribing penalties; and repealing existing laws," |
16 | further providing for continuing professional competency |
17 | requirements. |
18 | The General Assembly of the Commonwealth of Pennsylvania |
19 | hereby enacts as follows: |
20 | Section 1. Section 4.5(b) and (g) of the act of May 23, 1945 |
21 | (P.L.913, No.367), known as the Engineer, Land Surveyor and |
22 | Geologist Registration Law, amended May 12, 2010 (P.L.192, |
23 | No.25), are amended to read: |
24 | Section 4.5. Continuing Professional Competency |

1 | Requirements.--* * * |
2 | (b) [Each] Except as otherwise provided under subsection |
3 | (g), each licensee shall be required to meet the continuing |
4 | professional competency requirements of this section as a |
5 | condition for licensure renewal. Continuing professional |
6 | competency obtained by a licensee should maintain, improve or |
7 | expand skills and knowledge obtained prior to initial licensure, |
8 | including law and ethics applicable to the profession, or |
9 | develop new and relevant skills and knowledge. No credit shall |
10 | be given for a course in practice building or office management. |

12 | (g) (1) A licensee may [be exempt] request exemption from |
13 | the requirements of this section for any of the following |
14 | reasons and to the extent specified in this subsection: |
15 | (i) A licensee serving on temporary active duty in the armed |
16 | forces of the United States for a period of time exceeding one |
17 | hundred twenty consecutive days in a year shall be exempt from |
18 | obtaining the professional development hours required during |
19 | that year. |
20 | (ii) A licensee experiencing physical disability, illness or |
21 | other extenuating circumstances as reviewed and approved by the |
22 | board may be exempt. Supporting documentation must be furnished |
23 | to the board. |
24 | (iii) A licensee who lists his occupation as retired on the |
25 | board-approved renewal form and certifies to the board that he |
26 | no longer receives any remuneration for the practice of |
27 | engineering his licensed profession shall be exempt from the | <-- |
28 | requirement set forth in subsection (a) and the board shall | <-- |
29 | issue him a retired-status license. If the licensee intends to |
30 | return to the practice of engineering active practice, then the | <-- |

1 | licensee must complete the number of professional development |
2 | hours required for each year exempted, not to exceed the annual |
3 | requirement for two years. An individual who holds a | <-- |
4 | retired‑status license shall hold himself out to others as a |
5 | retired licensee, which includes using this designation in |
6 | advertising and signatures. |
7 | (2) An individual applying for initial licensure and |
8 | registration shall be exempt from the requirement set forth in |
9 | subsection (a) for the licensure period immediately following |
10 | initial licensure and registration. |

12 | Section 2. This act shall take effect in 60 days. |
