AN ACT

 

1Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
2act relating to the public school system, including certain
3provisions applicable as well to private and parochial
4schools; amending, revising, consolidating and changing the
5laws relating thereto," further providing for continuing
6professional development and for continuing professional
7education for school or system leaders.

8The General Assembly of the Commonwealth of Pennsylvania
9hereby enacts as follows:

10Section 1. Sections 1205.1(f)(1) and 1205.2(n.1)(1) of the
11act of March 10, 1949 (P.L.30, No.14), known as the Public
12School Code of 1949, amended July 5, 2012 (P.L.965, No.105), are
13amended to read:

14Section 1205.1. Continuing Professional Development.--* * *

15(f) (1) Beginning on the effective date of this subsection,
16the requirements under subsections (a), (b), (c), (c.1), (c.2),
17(c.3), (c.4), (d) and (e) shall be suspended until June 30,
18[2013] 2014.

20Section 1205.2. Program of Continuing Professional

1Education.--* * *

2(n.1) (1) Beginning on the effective date of this
3subsection, the requirements under subsections (a) and (f) shall
4be suspended until June 30, [2013. During that time, the
5Legislative Budget and Finance Committee shall conduct a study
6of the costs and benefits of the continuing professional
7education program. An interim report shall be due on November 
830, 2012, and the final report shall be due on March 1, 2013. On 
9July 1, 2013] 2014. No later than December 31, 2013, the 
10department shall present to the Education Committee of the 
11Senate and the Education Committee of the House of 
12Representatives a proposal to modify the Commonwealth's 
13professional development program to focus on the delivery of 
14professional development to school entities and school buildings 
15with unsatisfactory performance under the Pennsylvania School 
16Performance Profile. The department's proposal shall include 
17recommended legislation and an explanation in support of the 
18proposal. In developing the proposal, the department shall 
19consult with organizations representing school boards, school 
20administrators, school business officials, charter and cyber 
21charter schools, intermediate units, area vocational-technical 
22schools and professional educators. On July 1, 2014, each
23professional educator shall have the same number of hours of
24continuing professional education and the same amount of time in
25which to complete those hours as existed for the professional
26educator on the effective date of this subsection: Provided,
27however, That any continuing professional education credits or
28hours completed by a professional educator during the period of
29suspension under this subsection shall be credited to the
30professional educator's continuing professional education

1record. As used in this paragraph, "Pennsylvania School 
2Performance Profile" shall mean the Pennsylvania School 
3Performance Profile developed by the department pursuant to 
4section 1123.

6Section 2. Section 1205.5(h)(1) of the act, added June 30,
72011 (P.L.112, No.24), is amended to read:

8Section 1205.5. Continuing Professional Education for School
9or System Leaders.--* * *

10(h) (1) Beginning on the effective date of this subsection,
11the requirements of subsections (a), (c) and (d) shall be
12suspended until June 30, [2013] 2014.

14Section 3. This act shall take effect June 30, 2013, or
15immediately, whichever is sooner.
