AN ACT 1 Amending Title 34 (Game) of the Pennsylvania Consolidated 2 Statutes, further defining "closed season" and "open season"; 3 and further providing for hunting after lawful hours. 4 The General Assembly of the Commonwealth of Pennsylvania 5 hereby enacts as follows: 6 Section 1. The definitions of "closed season" and "open 7 season" in section 102 of Title 34 of the Pennsylvania 8 Consolidated Statutes are amended to read: 9 § 102. Definitions. 10 Subject to additional definitions contained in subsequent 11 provisions of this title which are applicable to specific 12 provisions of this title, the following words and phrases when 13 used in this title shall have the meanings given to them in this 14 section unless the context clearly indicates otherwise: 15 * * * 16 "Closed season." The periods of the calendar year and the 17 shooting hours during those periods of the calendar year during 18 which it is unlawful to take game or wildlife. The term shall
1 not include any nonshooting hours during an open season. 2 * * * 3 "Open season." The indicated periods of the calendar year 4 and the daily shooting hours during those periods of the 5 calendar year during which game or wildlife may be legally 6 hunted, taken or killed and includes both the first and the last 7 day of the season or period of time designated by this title or 8 by regulation of the commission. The term shall not include any 9 nonshooting hours during an open season. 10 * * * 11 Section 2. Title 34 is amended by adding a section to read: 12 § 2314. Lawful hunting hours. 13 (a) General rule.--Subject to modification by the commission 14 for certain species of wild game, the lawful hunting hours 15 during an open hunting season shall be one-half hour before 16 sunrise to sunset prevailing time. It is a violation of this 17 section to hunt during any open season at any other time. 18 (b) Penalty.--A violation of this section is a summary 19 offense of the fifth degree. 20 (c) Exception.--The provisions of this section shall not 21 apply to any person who is attempting to recover wild game which 22 was wounded during lawful hunting hours. 23 Section 3.
