AN ACT 1 To provide from the General Fund for the expenses of the 2 Executive, Legislative and Judicial Departments of the 3 Commonwealth, the public debt and for the public schools for 4 the fiscal year July 1, 2001, to June 30, 2002, for certain 5 institutions and organizations, and for the payment of bills 6 incurred and remaining unpaid at the close of the fiscal year 7 ending June 30, 2001; to provide appropriations from the 8 State Lottery Fund, the Energy Conservation and Assistance 9 Fund, the Hazardous Material Response Fund, The State Stores 10 Fund, the Milk Marketing Fund, the Home Investment Trust 11 Fund, the Emergency Medical Services Operating Fund, the 12 Tuition Payment Fund, the Banking Department Fund and the 13 Firearm Records Check Fund to the Executive Department; to 14 provide appropriations from the Judicial Computer System 15 Augmentation Account to the Judicial Department for the 16 fiscal year July 1, 2001, to June 30, 2002; to provide 17 appropriations from the Motor License Fund for the fiscal 18 year July 1, 2001, to June 30, 2002, for the proper operation 19 of the several departments of the Commonwealth and the 20 Pennsylvania State Police authorized to spend Motor License 21 Fund moneys; to provide for the appropriation of Federal 22 funds to the Executive Department of the Commonwealth and for 23 the establishment of restricted receipt accounts for the 24 fiscal year July 1, 2001, to June 30, 2002, and for the 25 payment of bills remaining unpaid at the close of the fiscal 26 year ending June 30, 2001. 27 TABLE OF CONTENTS 28 PART I. 1 PART XIX. EFFECTIVE DATE 2 Section 1901. Effective date. 3 The General Assembly of the Commonwealth of Pennsylvania 4 hereby enacts as follows: 5 PART I 6 GENERAL PROVISIONS 7 Section 101. Short title.--This act shall be known and may 8 be cited as the General Appropriation Act of 2001. 9 Section 102. Definitions.--The following words and phrases 10 when used in this act shall have the meanings given to them in 11 this section unless the context clearly indicates otherwise: 12 "Employees." Includes all directors, superintendents, bureau 13 or division chiefs, assistant directors, assistant 14 superintendents, assistant chiefs, experts, scientists, 15 engineers, surveyors, draftsmen, accountants, secretaries, 16 auditors, inspectors, examiners, analysts, statisticians, 17 marshals, clerks, stenographers, bookkeepers, messengers and 18 other assistants in any department, board or commission. 19 "Expenses" and "maintenance." Includes all printing, binding 20 and stationery, food and forage, materials and supplies, 21 traveling expenses, training, motor vehicle supplies and 22 repairs, freight, express and cartage, postage, telephones and 23 telegraph rentals and toll charges, newspaper advertising and 24 notices, public advertising by or through any medium, fuel, 25 light, heat, power and water, minor construction and renovation, 26 repairs or reconstruction of equipment, buildings and 27 facilities, rent of real estate and equipment, premiums on 28 workers' compensation, insurance premiums on policies of 29 liability insurance, insurance premiums on medical payment 30 insurance and surety bonds for volunteer workers, premiums on 20010H1216B1403 - 7 -
1 employee group life insurance and employee and retired employee 2 group hospital and medical insurance, payment of Commonwealth 3 share of Social Security taxes and unemployment compensation 4 costs for State employees, the purchase of replacement or 5 additional equipment and machinery and all other incidental 6 costs and expenses, including payment to the Department of 7 General Services of mileage and other charges for the use of 8 automobiles and rental payments for permanently assigned 9 automobiles and of expenses or costs of services incurred 10 through the Purchasing Fund. The term "expenses" also shall 11 include the medical costs for the treatment of inmates of State 12 institutions when the inmate must be transferred to an outside 13 hospital: Provided, That in no case shall the State institution 14 pay more for patient care than that provided under the State 15 medical assistance program. 16 Section 103. Abbreviations.--The following abbreviations 17 when used in this act shall have the meanings given to them in 18 this section unless the context clearly indicates otherwise: 19 "ARC." State appropriations.--(a) General Fund.--The 19 following sums set forth in this act, or as much thereof as may 20 be necessary, are hereby specifically appropriated from the 21 General Fund to the several hereinafter named agencies of the 22 Executive, Legislative and Judicial Departments of the 23 Commonwealth for the payment of salaries, wages or other 24 compensation and travel expenses of the duly elected or 25 appointed officers and employees of the Commonwealth, for the 26 payment of fees for contractual services rendered, for the 27 purchase or rental of goods and services, printing, public 28 advertising by or through any medium, equipment, land and 29 buildings and for payment of any other expenses, as provided by 30 law or by this act, necessary for the proper conduct of the 20010H1216B1403 - 9 -
1 duties, functions and activities and for the purposes 2 hereinafter set forth for the fiscal year beginning July 1, 3 2001, and for the payment of bills incurred and remaining unpaid 4 at the close of the fiscal year ending June 30, 2001. 5 (b) State Lottery Fund.--The following sums set forth in 6 this act, or as much thereof as may be necessary, are hereby 7 specifically appropriated from the State Lottery Fund to the 8 several hereinafter named agencies of the Executive Department 9 of the Commonwealth for the payment of salaries, wages or other 10 compensation and travel expenses of the duly appointed officers 11 and employees of the Commonwealth, for the payment of fees for 12 contractual services rendered, for the purchase or rental of 13 goods and services and for payment of any other expenses, as 14 provided by law or by this act, necessary for the proper conduct 15 of the duties, functions and activities and for the purposes 16 hereinafter set forth for the fiscal year beginning July 1, 17 2001, and for the payment of bills incurred and remaining unpaid 18 at the close of the fiscal year ending June 30, 2001. 19 (c) Energy Conservation and Assistance Fund.--The following 20 sums set forth in this act, or as much thereof as may be 21 necessary, are hereby specifically appropriated from the Energy 22 Conservation and Assistance Fund to the several hereinafter 23 named agencies of the Executive Department of the Commonwealth 24 for the payment of fees for contractual services rendered, for 25 the purchase or rental of goods and services and for the payment 26 of any other expenses, as provided by law or by this act, 27 necessary for the proper conduct of the duties, functions and 28 activities and for the purposes hereinafter set forth for the 29 fiscal year beginning July 1, 2001, and for the payment of bills 30 incurred and remaining unpaid at the close of the fiscal year 20010H1216B1403 - 10 -
1 ending June 30, 2001. 2 (d) Judicial Computer System Augmentation Account.--The 3 following sums set forth in this act, or as much thereof as may 4 be necessary, are hereby specifically appropriated from the 5 restricted receipt account established within the General Fund, 6 known as the Judicial Computer System Augmentation Account, to 7 the Judicial Department of the Commonwealth for the payment of 8 salaries, wages or other compensation and travel expenses, for 9 the payment of fees for contractual services rendered, for the 10 purchase or rental of goods and services and for the payment of 11 any other expenses, as provided by law or by this act, necessary 12 for the proper conduct of the duties, functions and activities 13 and for the purposes hereinafter set forth for the fiscal year 14 beginning July 1, 2001, and for the payment of bills incurred 15 and remaining unpaid at the close of the fiscal year ending June 16 30, 2001. 17 (e) Emergency Medical Services Operating Fund.--The 18 following sums set forth in this act, or as much thereof as may 19 be necessary, are hereby specifically appropriated from the 20 Emergency Medical Services Operating Fund to the several 21 hereinafter named agencies of the Executive Department of the 22 Commonwealth for the payment of fees for contractual services 23 rendered, for the purchase or rental of goods and services and 24 for the payment of any other expenses, as provided by law or by 25 this act, necessary for the proper conduct of the duties, 26 functions and activities and for the purposes hereinafter set 27 forth for the fiscal year beginning July 1, 2001, and for the 28 payment of bills incurred and remaining unpaid at the close of 29 the fiscal year ending June 30, 2001. 30 (f) The State Stores Fund.--The following sums set forth in 20010H1216B1403 - 11 -
1 this act, or as much thereof as may be necessary, are hereby 2 specifically appropriated from The State Stores Fund to the 3 hereinafter named agency of the Executive Department of the 4 Commonwealth for the payment of salaries, wages or other 5 compensation and travel expenses of the duly appointed officers 6 and employees of the Commonwealth, for the payment of fees for 7 contractual services rendered, for the purchase or rental of 8 goods and services and for the payment of any other expenses, as 9 provided by law or by this act, necessary for the proper conduct 10 of the duties, functions and activities and for the purposes 11 hereinafter set forth for the fiscal year beginning July 1, 12 2001, and for the payment of bills incurred and remaining unpaid 13 at the close of the fiscal year ending June 30, 2001. 14 (g) Motor License Fund.--The following sums, or as much 15 thereof as may be necessary, are hereby appropriated from the 16 Motor License Fund to the hereinafter named agencies of the 17 Executive Department for the payment of salaries, wages and 18 other compensation and travel expenses of the duly elected or 19 appointed officers and employees of the Commonwealth, for 20 contractual services and other expenses necessary for the proper 21 conduct of the duties, functions and activities for the purposes 22 hereinafter set forth for the fiscal year beginning July 1, 23 2001, and for the payment of bills incurred and remaining unpaid 24 at the close of the fiscal year ending June 30, 2001. 25 (h) Aviation Restricted Revenue Account.--The following 26 sums, or as much thereof as may be necessary, are hereby 27 appropriated from the Aviation Restricted Revenue Account in the 28 Motor License Fund to the hereinafter named agencies of the 29 Executive Department for the purposes set forth herein for the 30 fiscal year beginning July 1, 2001, and for the payment of bills 20010H1216B1403 - 12 -
1 incurred and remaining unpaid at the close of the fiscal year 2 ending June 30, 2001. 3 (i) Hazardous Material Response Fund.--The following sums 4 set forth in this act, or as much thereof as may be necessary, 5 are hereby specifically appropriated from the Hazardous Material 6 Response Fund to the several hereinafter named agencies of the 7 Executive Department of the Commonwealth for the payment of fees 8 for contractual services rendered, for the purchase or rental of 9 goods and services and for the payment of any other expenses, as 10 provided by law or by this act, necessary for the proper conduct 11 of the duties, functions and activities and for the purposes 12 hereinafter set forth for the fiscal year beginning July 1, 13 2001, and for the payment of bills incurred and remaining unpaid 14 at the close of the fiscal year ending June 30, 2001. 15 (j) Milk Marketing Fund.--The following sums set forth in 16 this act, or as much thereof as may be necessary, are hereby 17 specifically appropriated from the Milk Marketing Fund to the 18 several hereinafter named agencies of the Executive Department 19 of the Commonwealth for the payment of salaries, wages or other 20 compensation and travel expenses of the duly appointed officers 21 and employees of the Commonwealth, for the payment of fees for 22 contractual services rendered, for the purchase or rental of 23 goods and services and for the payment of any other expenses, as 24 provided by law or by this act, necessary for the proper conduct 25 of the duties, functions and activities and for the purposes 26 hereinafter set forth for the fiscal year beginning July 1, 27 2001, and for the payment of bills incurred and remaining unpaid 28 at the close of the fiscal year ending June 30, 2001. 29 (k) Home Investment Trust Fund.--The following sums set 30 forth in this act, or as much thereof as may be necessary, are 20010H1216B1403 - 13 -
1 hereby specifically appropriated from the Home Investment Trust 2 Fund to the hereinafter named agencies of the Executive 3 Department of the Commonwealth for the payment of salaries, 4 wages or other compensation and travel expenses of the duly 5 appointed officers and employees of the Commonwealth, for the 6 payment of fees for contractual services rendered, for the 7 purchase or rental of goods and services and for the payment of 8 any other expenses, as provided by law or by this act, necessary 9 for the proper conduct of the duties, functions and activities 10 and for the purposes hereinafter set forth for the fiscal year 11 beginning July 1, 2001, and for the payment of bills incurred 12 and remaining unpaid at the close of the fiscal year ending June 13 30, 2001. 14 (l) Tuition Payment Fund.--The following sums set forth in 15 this act, or as much thereof as may be necessary, are hereby 16 specifically appropriated from the Tuition Payment Fund to the 17 hereinafter named agencies of the Executive Department of the 18 Commonwealth for the payment of salaries, wages or other 19 compensation and travel expenses of the duly appointed officers 20 and employees of the Commonwealth, for the payment of fees for 21 contractual services rendered, for the purchase or rental of 22 goods and services and for the payment of any other expenses, as 23 provided by law or by this act, necessary for the proper conduct 24 of the duties, functions and activities and for the purposes 25 hereinafter set forth for the fiscal year beginning July 1, 26 2001, and for the payment of bills incurred and remaining unpaid 27 at the close of the fiscal year ending June 30, 2001. 28 (m) Banking Department Fund.--The following sums set forth 29 in this act, or as much thereof as may be necessary, are hereby 30 specifically appropriated from the Banking Department Fund to 20010H1216B1403 - 14 -
1 the hereinafter named agencies of the Executive Department of 2 the Commonwealth for the payment of salaries, wages or other 3 compensation and travel expenses of the duly appointed officers 4 and employees of the Commonwealth, for the payment of fees for 5 contractual services rendered, for the purchase or rental of 6 goods and services and for the payment of any other expenses, as 7 provided by law or by this act, necessary for the proper conduct 8 of the duties, functions and activities and for the purposes 9 hereinafter set forth for the fiscal year beginning July 1, 10 2001, and for the payment of bills incurred and remaining unpaid 11 at the close of the fiscal year ending June 30, 2001. 12 (n) Firearm Records Check Fund.--The following sums set 13 forth in this act, or as much thereof as may be necessary, are 14 hereby specifically appropriated from the Firearm Records Check 15 Fund to the hereinafter named agencies of the Executive 16 Department of the Commonwealth for the payment of salaries, 17 wages or other compensation and travel expenses of the duly 18 appointed officers and employees of the Commonwealth, for the 19 payment of fees for contractual services rendered, for the 20 purchase or rental of goods and services and for the payment of 21 any other expenses, as provided by law or by this act, necessary 22 for the proper conduct of the duties, functions and activities 23 and for the purposes hereinafter set forth for the fiscal year 24 beginning July 1, 2001, and for the payment of bills incurred 25 and remaining unpaid at the close of the fiscal year ending June 26 30, 2001. 27 Section 105. Federal augmentation appropriations.--The 28 following Federal augmentation appropriations set forth in this 29 act, or as much thereof as may be necessary, are hereby 30 specifically appropriated from the Federal augmentation funds to 20010H1216B1403 - 15 -
1 the several hereinafter named agencies of the Executive 2 Department of the Commonwealth for the payment of the expenses 3 of implementing and carrying out the programs stated herein for 4 the fiscal year beginning July 1, 2001, and for the payment of 5 bills incurred and remaining unpaid at the close of the fiscal 6 year ending June 30, 2001. Unless otherwise stated, the 7 appropriations include any carryovers from the prior fiscal 8 year. 9 Section 106. Block grants.--(a) Appropriation.--The 10 following sums set forth in this act, or as much thereof as may 11 be necessary, are hereby specifically appropriated from the 12 block grant (BG) funds to the several hereinafter named agencies 13 of the Executive Department of the Commonwealth for the 14 purposes, and under the restrictions, for which the funds are 15 provided for the fiscal year beginning July 1, 2001. 16 (b) Small Communities Development Block Grant.--The Small 17 Communities Development Block Grant (SCDBG) is to assist small 18 cities and communities that have a high concentration of 19 impoverished citizens and substandard housing to expand their 20 low-income and moderate-income housing opportunities and to meet 21 community development needs. 22 (c) Community Services Block Grant.--The Community Services 23 Block Grant (CSBG) is to provide a range of services and 24 activities having a measurable and potentially major impact on 25 the causes of poverty in the community or those areas of the 26 community where poverty is a particularly acute problem. In 27 addition, new focus may be placed on the unemployed, both old 28 and new. 1 or supplements to the departments or agencies of the 2 Commonwealth or the programs herein provided shall be paid into 3 the General Fund. 4 Section 1702. Limitation on encumbering or spending Federal 5 funds.--Federal funds shall be encumbered or spent only to the 6 extent that such funds are estimated as being available during 7 the fiscal year of the Commonwealth. 8 Section 1703. Appropriation of prior unspent Federal 9 funds.--Any Federal money which has been previously appropriated 10 by the General Assembly and authorized or allocated by the 11 Federal Government but remains unspent from prior fiscal years 12 and will not be renewed for fiscal year 2001-2002 is hereby 13 appropriated. 14 Section 1704. Subgrants between Federal fund 15 appropriations.--With the exception of Federal money received 16 under SSBG, subgrants may be made between appropriations without 17 further approval of the General Assembly. The Secretary of the 18 Budget shall submit a list of subgrants to the chairman and 19 minority chairman of the Appropriations Committee of the Senate 20 and the chairman and minority chairman of the Appropriations 21 Committee of the House of Representatives quarterly. No subgrant 22 to a State agency, however, may be made from a restricted 23 receipt account without a specific appropriation by the General 24 Assembly. 25 Section 1705. Utilization of emergency Federal funds.--(a) 26 Federal funds available for costs and damages resulting from 27 natural disasters or civil disobedience may be added to an 28 appropriation contained in this act or to funds appropriated or 29 may be used for the purposes prescribed by the Federal 30 Government. 20010H1216B1403 - 192 -
1 (b) In addition to the moneys appropriated by this act, all 2 moneys received from the Federal Government for the purpose of 3 disaster assistance or relief shall be paid into the General 4 Fund and are hereby appropriated out of the General Fund to the 5 departments, boards, commissions or agencies designated by the 6 Governor. 7 (c) In the event of any emergency situation in which the 8 General Assembly cannot act in sufficient time, the Governor is 9 authorized through executive authorization to provide up to 10 $10,000,000 in Federal funds to alleviate the emergency 11 situation. For the purposes of this section, "emergency" is 12 defined as any situation in which there is a chance of or which 13 may result in substantial human suffering. 14 Section 1706. Transfer of funds from TANFBG to CCDFBG and 15 SSBG.--In accordance with Federal law which permits the transfer 16 of funds from the TANFBG to the CCDFBG and SSBG, the Department 17 of Public Welfare, upon approval of the Secretary of the Budget, 18 may make such transfers of funds provided that any such transfer 19 will not result in a deficit in any appropriation from which 20 funds are transferred. The Secretary of the Budget shall provide 21 notification of any such transfers to the chairman and the 22 minority chairman of the Appropriations Committee of the Senate 23 and the chairman and minority chairman of the Appropriations 24 Committee of the House of Representatives ten days prior to any 25 transfer which shall also include certification that such 26 transfer will not result in a deficit in any appropriation. 27 PART XVIII 28 MISCELLANEOUS PROVISIONS FOR 2001-2002 29 Section 1801. Prior laws unaffected.--Except as provided in 30 section 253, this act is not intended to be inconsistent with or 20010H1216B1403 - 193 -
1 to repeal any provision of any act enacted at this or any prior 2 session of the General Assembly regulating the purchase of 3 supplies, the ordering of printing and binding, the purchase, 4 maintenance and use of automobiles, the method of making 5 payments from the State Treasury for any purpose or the 6 functioning of any administrative department, board or 7 commission. 8 Section 1802. Compliance with other law before funds 9 available.--No appropriation made by this act to any department, 10 board, commission or agency of the Executive Department shall be 11 available unless and until the department, board, commission or 12 agency has complied with sections 615 and 616 of the act of 13 April 9, 1929 (P.L.177, No.175), known as The Administrative 14 Code of 1929. 15 Section 1803. Contracts prerequisite to encumbering or 16 committing funds.--Funds available to agencies, boards, 17 departments, commissions, or other governmental entities under 18 this act for the procurement of supplies, services or 19 construction shall not be available for payment of, or to be 20 committed to or encumbered for payment of, any such procurement 21 unless and until the agency, board, department or other 22 governmental entity has complied with all of the requirements 23 applicable to the procurement that are set out in 62 Pa.C.S. 24 (relating to procurement) and in the policies, procedures and 25 regulations instituted in accordance with that code. 26 Section 1804. Minority business set-asides.--(a) Each 27 department or other instrumentality of the Commonwealth listed 28 in Subpart A of Part II authorized to contract for buildings, 29 highways, commodities, equipment, supplies or services shall 30 report to the General Assembly all information pertinent to 20010H1216B1403 - 194 -
1 anticipated procurement needs at the beginning of each fiscal 2 year and each fiscal quarter thereafter. 3 (b) As used in this section, the term "minority business" 4 means a minority business enterprise as defined in the act of 5 July 22, 1974 (P.L.598, No.206), known as the Pennsylvania 6 Minority Business Development Authority Act. 7 Section 1805. Appropriation of funds from miscellaneous 8 sources.--(a) In addition to the amounts appropriated by this 9 act, moneys received in payment for food and household supplies 10 furnished to employees and other persons, except inmates, by an 11 institution, and moneys received from the proceeds from the sale 12 of any products of the soil, meats, livestock, timber or other 13 materials sold by the department shall be paid into the General 14 Fund and are hereby appropriated out of the General Fund to the 15 several respective institutions for the operation and 16 maintenance of the institutions. 17 (b) In addition to the amounts appropriated by this act, all 18 moneys received from any other source, except the Federal 19 Government, as contributions for the programs provided herein or 20 as payment for services or materials furnished by one 21 institution to another, except those collections designated as 22 revenues, shall be paid into the General Fund and are hereby 23 appropriated out of the General Fund for the purposes of the 24 respective appropriations. 25 (c) In addition to any funds specifically appropriated by 26 this act, all moneys received by a department or agency of the 27 Commonwealth from any other sources, except the Federal 28 Government, as contributions or supplements to the department or 29 agency for a program or administration of an act included in 30 this act shall be paid into the General Fund and credited to the 20010H1216B1403 - 195 -
1 appropriation for that program or administration of the act. 2 Section 1806. Lapsing of unused funds.--(a) Except as 3 otherwise provided by law or by this section, that part of all 4 appropriations in Parts II, III, IV, V, VI, VII, VIII, IX, X, 5 XI, XII, XIII, XIV and XV unexpended, uncommitted or 6 unencumbered as of June 30, 2002, shall automatically lapse as 7 of that date. 8 (b) The appropriations in Part II to the Legislative 9 Department shall be continuing appropriations. 10 Section 1807. Appellate courts appropriation contingency.-- 11 The funds appropriated in Part II to the Supreme, Superior and 12 Commonwealth Courts for justice and judge expenses are 13 contingent upon a vouchered expense account plan being continued 14 by the Supreme Court. 15 Section 1808. Transfer of excess funds.--The Governor may 16 transfer any excess money in those funds receiving proceeds of 17 Commonwealth of Pennsylvania general obligation bonds in excess 18 of the amount necessary for the purposes for which the bonds 19 were issued to the appropriate sinking fund for payment of debt 20 service due on outstanding bonds. If such excess funds, together 21 with any available balance, exceed the amount of debt service 22 remaining to be paid, the funds shall be transferred to the 23 General Fund or to the appropriate special fund responsible for 24 such debt service. 25 Section 1809. Transfer of funds by the Supreme Court.--(a) 26 The Supreme Court may transfer any excess funds appropriated in 27 sections 281, 285, 286, 287, 290 and 291 to the Judicial 28 Department in Part II to the Judicial Computer Augmentation 29 Account during the month of June 2002. No transfer may create or 30 increase a deficiency in the appropriation from which the 20010H1216B1403 - 196 -
1 transfer is made. Whenever the Supreme Court makes a transfer 2 under this subsection, the Supreme Court shall give written 3 notification to the Secretary of the Budget and chairman and 4 minority chairman of the Senate Committee on Appropriations and 5 the chairman and the minority chairman of the House of 6 Representatives Committee on Appropriations ten days prior to 7 any transfer which shall also include certification that such 8 transfer will not result in a deficit in any appropriation. 9 (b) The Supreme Court may transfer funds appropriated in 10 section 281 between the line items in that section provided that 11 no transfer may create or increase a deficiency in the 12 appropriation from which the transfer is made. Whenever the 13 Supreme Court makes a transfer under this subsection, the 14 Supreme Court shall give written notification to the Secretary 15 of the Budget and the chairman and minority chairman of the 16 Senate Committee on Appropriations and the chairman and the 17 minority chairman of the House of Representatives Committee on 18 Appropriations ten days prior to any transfer which shall also 19 include certification that such transfer will not result in a 20 deficit in any appropriation. 21 Section 1810. Transfer from Capital Debt Fund.--The sum of 22 $100,000,000 is transferred from the Capital Debt Fund to the 23 Capital Facilities Fund. 24 Section 1811. Transfer from the SciTech and Technology 25 Scholarship Program.--The sum of $20,000,000 is transferred from 26 the SciTech and Technology Scholarship Program in the 27 Pennsylvania Higher Education Assistance Agency to the General 28 Fund appropriations from which the funds were originally 29 transferred and shall lapse. 30 PART XIX 20010H1216B1403 - 197 -
