        AS REPORTED FROM COMMITTEE ON GAME AND FISHERIES, HOUSE OF

                                     AN ACT

     1  Amending Title 30 (Fish) of the Pennsylvania Consolidated
     2     Statutes, restricting the possession TRANSPORT, sale,          <--
     3     importation or release of snakehead fish.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Title 30 of the Pennsylvania Consolidated
     7  Statutes is amended by adding a section to read:
     8  § 2508.  Restrictions on possession TRANSPORT, sale, importation  <--
     9             or release of snakehead fish.
    10     (a)  General rule.--No person shall possess TRANSPORT, sell,   <--
    11  offer for sale or release in this Commonwealth or import, bring
    12  or cause to be brought or imported into this Commonwealth a
    13  snakehead fish of the genus Channa or the genus Ophicephalus.
    14     (B)  CONSTRUCTION.--POSSESSION OF A SNAKEHEAD FISH OF THE      <--
    15  GENUS CHANNA OR THE GENUS OPHICEPHALUS SHALL BE SUBJECT TO


     1  PROSECUTION UNDER SECTION 2102(A) AND (C) (RELATING TO RULES AND
     2  REGULATIONS).
     3     (b) (C)  Penalty.--Any person who violates this section        <--
     4  commits a misdemeanor of the third degree.
     5     SECTION 2.  THE PROVISIONS OF 30 PA.C.S. § 2102 ARE REPEALED   <--
     6  INSOFAR AS THEY ARE INCONSISTENT WITH THIS ACT.
     7     Section 2 3.  This act shall take effect in 60 days.           <--
