                                     AN ACT

     1  Amending Title 27 (Environmental Resources) of the Pennsylvania
     2     Consolidated Statutes, further providing for utilization of
     3     certain moneys by the Department of Environmental Protection.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 6105(b) of Title 27 of the Pennsylvania
     7  Consolidated Statutes is amended to read:
     8  § 6105.  Agencies.

    10     (b)  The Department of Environmental Protection.--
    11         * * *
    12         (4) (i)  For the period commencing with the effective
    13         date of this chapter and ending June 30, 2004, the
    14         Department of Environmental Protection [may] must utilize
    15         [up to] at least 10% of the money allocated annually to


     1         it under section 6104(d) (relating to fund) to provide
     2         grants for safe drinking water projects and wastewater
     3         treatment projects. [Grants] With the exception of grants
     4         and matching grants provided for under subparagraph (ii),
     5         grants under this paragraph shall be made for the same
     6         purposes and shall be subject to the same limitations as
     7         grants authorized in section 6110.
     8             (ii)  An applicant that has expended $25,000,000 or
     9         more for a wastewater treatment project to act in
    10         accordance with a compliance order issued by the
    11         Department of Environmental Protection shall be eligible
    12         to receive grants and matching grants provided for under
    13         this section to offset the cost of the project.

    15     Section 2.  This act shall take effect immediately.
