AN ACT
Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
Statutes, in rules of the road in general, prohibiting use of
handheld mobile telephones.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Title 75 of the Pennsylvania Consolidated
Statutes is amended by adding a section to read:
ยง 3317. Prohibiting use of handheld mobile telephones.
(a) General rule.--Except as provided in subsection (b), no
driver shall operate a moving vehicle on a highway of this
Commonwealth, which shall include Federal, State and municipal
highways, while using a handheld mobile telephone.
(b) Exception.--This section shall not apply to law
enforcement officers and operators of emergency vehicles when on
duty and acting in their official capacities.
(c) Defense.--It shall be a defense to an action under this
section that the driver had reason to fear for the driver's
safety, was reporting a traffic accident or was making a 911
