                                     AN ACT

     1  Amending Title 42 (Judiciary and Judicial Procedure) of the
     2     Pennsylvania Consolidated Statutes, providing certain
     3     judicial vacancies to be filled by election.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1. Title 42 of the Pennsylvania Consolidated Statutes
     7  is amended by adding a section to read:
     8  § 3351.1.  Certain vacancies to be filled by election.
     9     When mandatory retirement provisions of law create an
    10  anticipated vacancy in the office of justice, judge or district
    11  justice to be filled through a regularly conducted election and
    12  a proposed constitutional amendment providing that justices,
    13  judges and district justices be retired on the last day of the
    14  calendar year in which they attain 70 years of age is submitted
    15  to the electorate at same primary election and is adopted, the
    16  vacancy so created shall be filled by the concurrent election.
    17  The individual elected to fill the vacancy shall take office
    18  upon the retirement of the justice, judge or district justice.

     1     Section 2.  This act shall take effect immediately.
