        AS REPORTED FROM COMMITTEE ON LOCAL GOVERNMENT, HOUSE OF
           REPRESENTATIVES, AS AMENDED, OCTOBER 1, 2001

                                     AN ACT

     1  Amending the act of February 1, 1966 (1965 P.L.1656, No.581),
     2     entitled "An act concerning boroughs, and revising, amending
     3     and consolidating the law relating to boroughs," further
     4     providing for the composition of the shade tree commission.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Section 2722 of the act of February 1, 1966 (1965
     8  P.L.1656, No.581), known as The Borough Code, is amended to
     9  read:
    10     Section 2722.  Composition of Commission.--(a)  The
    11  commission shall be composed of three OR FIVE residents of the    <--
    12  borough, AS DETERMINED BY COUNCIL, who shall be appointed by the  <--
    13  council, and shall serve without compensation.
    14     (b)  Whenever a shade tree commission of three members is
    15  established by any borough, the council shall appoint one member
    16  for a term of three years, one for a term of four years, and one
    17  for a term of five years. On the expiration of the term of any

     1  commissioner, a successor shall be appointed by the council to
     2  serve for a term of five years.
     3     (c)  Whenever a shade tree commission of five members is
     4  established by any borough, the council shall appoint members to
     5  staggered terms so that one term expires every year. On the
     6  expiration of the term of any commissioner, a successor shall be
     7  appointed by the council to serve for a term of five years.
     8     (d)  Vacancies in the office of commissioner shall be filled
     9  by the council for the unexpired term.
    10     Section 2.  This act shall take effect in 60 days.
