AN ACT 1 Amending the act of August 26, 1971 (P.L.351, No.91), entitled 2 "An act providing for a State Lottery and administration 3 thereof; authorizing the creation of a State Lottery 4 Commission; prescribing its powers and duties; disposition of 5 funds; violations and penalties therefor; exemption of prizes 6 from State and local taxation and making an appropriation," 7 further providing for prohibited sales. 8 The General Assembly of the Commonwealth of Pennsylvania 9 hereby enacts as follows: 10 Section 1. Section 309 of the act of August 26, 1971 11 (P.L.351, No.91), known as the State Lottery Law, amended 12 November 21, 1996 (P.L.741, No.134), is amended to read: 13 Section 309. Certain sales prohibited. 14 (a) Minors.-- 15 (1) No ticket or share shall be sold to any person under 16 18 years of age. For the purpose of making a gift, a person 17 18 years of age or older may purchase a ticket or share for 18 the benefit of a person less than that age. 19 (1.1) No ticket or share shall be sold through the use 20 of a mechanical or an electrical device.
1 (2) Any agent or employee of any agent who knowingly 2 sells or permits the sale of a lottery ticket or share to any 3 person [under 18 years of age] in violation of this section 4 shall be guilty of a misdemeanor, and upon conviction 5 thereof, shall be sentenced to pay a fine of not more than 6 $500. 7 (b) Certain employees.--No ticket or share shall be sold to 8 and no prize shall be awarded to any officer or employee of the 9 division in the Department of Revenue or any spouse, child, 10 brother, sister or parent residing as a member of the same 11 household in the principal place of abode of any of the 12 foregoing persons. 13 Section 2.
