AN ACT 1 Providing for the Pennsylvania Gaming Economic Development and 2 Tourism Fund Capital Budget for 2007-2008 2007; itemizing <-- 3 projects to be assisted by the Department of Community and 4 Economic Development, together with their estimated financial 5 costs; authorizing recurring payments for certain projects; 6 and making appropriations. 7 The General Assembly of the Commonwealth of Pennsylvania 8 hereby enacts as follows: 9 Section 1. Short title. <-- 10 This act shall be known and may be cited as the Pennsylvania 11 Gaming Economic Development and Tourism Fund Capital Budget 12 Itemization Act for 2007-2008. 13 Section 2. Total authorizations from Pennsylvania Gaming 14 Economic Development and Tourism Fund. 15 The total authorization for the projects itemized in section 16 3 for grants by the Department of Community and Economic 17 Development, its successors or assigns, and to be financed from 18 the revenues of the Pennsylvania Gaming Economic Development and
1 Tourism Fund shall be $1,647,941,000. 2 Section 3. Duration of payments. 23 Notwithstanding any other provisions of law, the following 24 shall apply to the projects authorized in section 3: 25 (1) The amount allocated to the project described in 26 section 3(2)(i)(A) shall be made through 2014-2015 in annual 27 amounts, not to exceed $7,782,000 each, pursuant to an 28 agreement with the Commonwealth specifying the amounts to be 29 paid each year. 1 (2) The amount allocated to the project described in 2 section 3(2)(i)(C) shall be made in annual amounts, not to 3 exceed $2,000,000, for ten years. However, the amount paid 4 shall not exceed the operating deficit of the David L. 5 Lawrence Convention Center. 6 (3) The amount allocated to the projects described in 7 section 3(2)(i)(D) shall be made in annual amounts, not to 8 exceed $8,000,000, including $500,000 to a nonprofit 9 community development fund to fund infrastructure, 10 construction and redevelopment projects, for 30 years or the 11 retirement of the debt issued for the projects described in 12 section 3(2)(i)(D), whichever is less. 13 (3.1) The amount allocated to the project described in 14 section 3(40)(i)(A) shall be made in annual amounts, not to 15 exceed $16,500,000, for 30 years or the retirement of the 16 debt issued for the project described in section 3(40)(i)(A), 17 whichever is less. 18 (4) The amount allocated to the projects described in 19 section 3(2)(i)(E) shall be made in annual amounts, not to 20 exceed $15,000,000, for ten years. 21 (5) The amount allocated to the project described in 22 section 3(51)(i)(A) and shall be made in annual amounts, not 23 to exceed $64,000,000, for 30 years or the retirement of the 24 debt issued for the project described in section 3(51)(i)(A), 25 whichever is less. However, the amount paid may not exceed 26 the actual amounts of debt service and $6,000,000 for 27 operating expenses in any year. Payments made pursuant to 28 section 3(51)(i)(A) which are reimbursements to the General 29 Fund shall be deposited into the Capital Debt Fund for 30 repayment of the debt issued. 20070H1631B2345 - 36 -
1 Section 5. Appropriation. 2 The sums necessary for the annual amounts itemized in 3 sections 3 and 4 are hereby appropriated from the Pennsylvania 4 Gaming Economic Development and Tourism Fund to the Department 5 of Community and Economic Development, upon approval of the 6 Governor, for the projects itemized in this act. 7 Section 6. Special provisions. 8 (a) Notwithstanding the provisions of 4 Pa.C.S. § 1407(d) 9 (relating to Pennsylvania Gaming Economic Development Tourism 10 Fund), the projects authorized in section 3(2)(I)(D) shall be 11 eligible for funding from the Pennsylvania Gaming and Economic 12 Development and Tourism Fund. 13 (b) Notwithstanding any other law to the contrary, the 14 requirements of section 318 of the act of February 9, 1999 15 (P.L.1, No.1), known as the Capital Facilities Debt Enabling 16 Act, shall provide the sole and exclusive requirements for 17 bidding for the acquisition, development construction of the 18 project in section 3(2)(i)(D). 19 Section 7. Editorial changes. 20 In editing and preparing this act for printing following the 21 final enactment, the Legislative Reference Bureau shall insert 22 or revise letters or numbers for projects where the letters or 23 numbers are missing or require revision. The bureau shall also 24 revise the total monetary amounts for the total authorization, 25 debt authorization, appropriations and departmental totals as 26 necessary to agree with the total monetary amounts of the 27 projects. 28 Section 8. THE REMAINING UNPAID 20 BALANCE OF THE TOTAL AMOUNT AUTHORIZED IN SECTION 3 SHALL BE 21 PAID IN TOTAL WITHIN THE NEXT TWO FISCAL YEARS. 22 (2) THE AMOUNT ALLOCATED TO THE PROJECT DESCRIBED IN 23 SECTION 3(2)(I)(B) SHALL BE PAID IN ANNUAL AMOUNTS OF NOT 24 LESS THAN $1,700,000 FOR TEN YEARS. THE REMAINING UNPAID 25 BALANCE OF THE TOTAL AMOUNT AUTHORIZED IN SECTION 3 SHALL BE 26 PAID IN TOTAL WITHIN THE NEXT TWO FISCAL YEARS. 27 (3) THE AMOUNT ALLOCATED TO THE PROJECT DESCRIBED IN 28 SECTION 3(2)(I)(C) SHALL BE PAID IN ANNUAL AMOUNTS OF NOT 29 LESS THAN $1,700,000 FOR TEN YEARS. LAWRENCE CONVENTION CENTER. 4 (4) THE AMOUNT ALLOCATED TO THE PROJECTS DESCRIBED IN 5 SECTION 3(2)(I)(D) SHALL BE PAID IN ANNUAL AMOUNTS, NOT TO 6 EXCEED $7,500,000, FOR 30 YEARS OR THE RETIREMENT OF THE DEBT 7 ISSUED FOR THE PROJECTS DESCRIBED IN SECTION 3(2)(I)(D), 8 WHICHEVER IS LESS. 9 (5) THE AMOUNT ALLOCATED TO THE PROJECTS DESCRIBED IN 10 SECTION 3(2)(I)(E) SHALL BE PAID IN ANNUAL AMOUNTS OF NOT 11 LESS THAN $12,400,000 FOR TEN YEARS. THE REMAINING UNPAID 12 BALANCE OF THE TOTAL AMOUNT AUTHORIZED IN SECTION 3 SHALL BE 13 PAID IN TOTAL WITHIN THE NEXT TWO FISCAL YEARS. 14 (6) THE AMOUNT ALLOCATED TO THE PROJECT DESCRIBED IN 15 SECTION 3(2)(I)(F) SHALL BE PAID IN ANNUAL AMOUNTS OF NOT 16 LESS THAN $6,600,000 FOR TEN YEARS. THE REMAINING UNPAID 17 BALANCE OF THE TOTAL AMOUNT AUTHORIZED IN SECTION 3 SHALL BE 18 PAID IN TOTAL WITHIN THE NEXT TWO FISCAL YEARS. 19 (7) THE AMOUNT ALLOCATED TO THE PROJECT DESCRIBED IN 20 SECTION 3(2)(I)(G) SHALL BE PAID IN ANNUAL AMOUNTS OF NOT 21 LESS THAN $3,700,000 FOR TEN YEARS. THE REMAINING UNPAID 22 BALANCE OF THE TOTAL AMOUNT AUTHORIZED IN SECTION 3 SHALL BE 23 PAID IN TOTAL WITHIN THE NEXT TWO FISCAL YEARS. 24 (8) THE AMOUNT ALLOCATED TO THE PROJECT DESCRIBED IN 25 SECTION 3(2)(I)(H) SHALL BE PAID IN ANNUAL AMOUNTS OF NOT 26 LESS THAN $2,500,000 FOR TEN YEARS. 1 EXCEED $64,000,000, FOR UP TO 30 YEARS FOR THE RETIREMENT OF 2 THE DEBT ISSUED OR OPERATING EXPENSES FOR THE PROJECT 3 DESCRIBED IN SECTION 3(51)(I)(A). HOWEVER, THE AMOUNT PAID 4 MAY NOT EXCEED THE ACTUAL AMOUNTS OF DEBT SERVICE AND 5 $6,000,000 FOR OPERATING EXPENSES IN ANY YEAR. PAYMENTS MADE 6 PURSUANT TO THIS PARAGRAPH WHICH ARE REIMBURSEMENTS TO THE 7 GENERAL FUND SHALL BE DEPOSITED INTO THE CAPITAL DEBT FUND 8 FOR REPAYMENT OF DEBT ISSUED. PAYMENTS AUTHORIZED UNDER THIS 9 PARAGRAPH SHALL NOT EXCEED $880,000,000. 10 SECTION 5. LIMITATION ON EXPENDITURES. 11 BEGINNING IN FISCAL YEAR 2007-2008, IT SHALL BE MANDATORY, 12 NOT DIRECTORY, THAT PAYMENTS MADE PURSUANT TO SECTION 4(1), (2), 13 (3), (5), (6), (7) AND (8) SHALL BE MADE EACH YEAR FROM THE 14 GAMING ECONOMIC DEVELOPMENT AND TOURISM FUND BY THE DEPARTMENT 15 OF COMMUNITY AND ECONOMIC DEVELOPMENT. IN SUCH YEARS THAT IT IS 16 DETERMINED FOR ANY REASON THAT THERE ARE NOT SUFFICIENT FUNDS TO 17 MAKE THESE MANDATORY PAYMENTS, EACH MANDATORY PAYMENT SHALL BE 18 PROPORTIONATELY REDUCED IN AN AMOUNT EQUAL TO THE SHORTFALL IN 19 THE GAMING ECONOMIC DEVELOPMENT AND TOURISM FUND. TOTAL 20 EXPENDITURES UNDER THIS ACT FOR THE PROJECTS REFERRED TO IN 21 SECTION 4 SHALL NOT EXCEED THE TOTAL AMOUNT AUTHORIZED FOR EACH 22 PROJECT IN SECTION 3. 23 SECTION 6. APPROPRIATION. 24 THE SUMS NECESSARY FOR THE ANNUAL AMOUNTS ITEMIZED IN 25 SECTIONS 3 AND 4 ARE HEREBY APPROPRIATED FROM THE PENNSYLVANIA 26 GAMING ECONOMIC DEVELOPMENT AND TOURISM FUND TO THE DEPARTMENT 27 OF COMMUNITY AND ECONOMIC DEVELOPMENT, UPON APPROVAL OF THE 28 GOVERNOR, FOR THE PROJECTS ITEMIZED IN THIS ACT. 29 SECTION 7. SPECIAL PROVISIONS. 30 (A) ELIGIBILITY FOR FUNDING.--NOTWITHSTANDING THE PROVISIONS 20070H1631B2345 - 45 -
1 OF 4 PA.C.S. § 1407(D) (RELATING TO PENNSYLVANIA GAMING ECONOMIC 2 DEVELOPMENT TOURISM FUND), THE PROJECTS AUTHORIZED IN SECTION 3 3(2)(I)(D) AND (51)(I)(A) SHALL BE ELIGIBLE FOR FUNDING FROM THE 4 PENNSYLVANIA GAMING AND ECONOMIC DEVELOPMENT AND TOURISM FUND. 5 (B) BIDDING.--NOTWITHSTANDING ANY OTHER LAW TO THE CONTRARY, 6 THE REQUIREMENTS OF SECTION 318 OF THE ACT OF FEBRUARY 9, 1999 7 (P.L.1, NO.1), KNOWN AS THE CAPITAL FACILITIES DEBT ENABLING 8 ACT, SHALL PROVIDE THE SOLE AND EXCLUSIVE REQUIREMENTS FOR 9 BIDDING FOR THE ACQUISITION, DEVELOPMENT CONSTRUCTION OF THE 10 PROJECT IN SECTION 3(2)(I)(D). 11 (C) DELEGATION.--NOTWITHSTANDING ANY PROVISION OF LAW TO THE 12 CONTRARY, THE DEPARTMENT OF GENERAL SERVICES MAY DELEGATE THE 13 DESIGN AND CONSTRUCTION OF THE PROJECT DESCRIBED IN SECTION 14 3(51)(I)(A) TO THE PENNSYLVANIA CONVENTION CENTER AUTHORITY. ALL 15 CONTRACTS FOR THE EXPENDITURE OF FUNDS FOR THE PROJECT DESCRIBED 16 IN SECTION 3(51)(I)(A) SHALL BE SUBJECT TO 64 PA.C.S. CH. 60 17 (RELATING TO PENNSYLVANIA CONVENTION CENTER AUTHORITY). 18 (D) PAYMENTS TO COUNTY OF SECOND CLASS.--NOTWITHSTANDING ANY 19 OTHER PROVISION OF LAW TO THE CONTRARY, PAYMENTS FROM FUNDS 20 APPROPRIATED FOR PROJECTS ITEMIZED IN SECTION 3(2)(I)(E), (F) 21 AND (H) SHALL BE MADE TO A COUNTY OF THE SECOND CLASS FOR USE AS 22 SPECIFIED IN THIS ACT AND IN 4 PA.C.S. § 1407(D). 23 SECTION 8.
