           ROONEY, JAMES, RAMOS, WALKO, EACHUS, C. WILLIAMS, MELIO,
           TIGUE, CORPORA, SATHER, READSHAW, HALUSKA, THOMAS, TRELLO,
           LYNCH, CORRIGAN, CLARK, SEYFERT AND BOSCOLA, JUNE 11, 1997

                                     AN ACT

     1  Amending the act of February 1, 1966 (1965 P.L.1656, No.581),
     2     entitled "An act concerning boroughs, and revising, amending
     3     and consolidating the law relating to boroughs," exempting
     4     boroughs from certain filing and service fees.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Section 3301 of the act of February 1, 1966 (1965
     8  P.L.1656, No.581), known as The Borough Code, amended October 9,
     9  1967 (P.L.399, No.181) and repealed in part April 28, 1978
    10  (P.L.202, No.53), is amended to read:
    11     Section 3301.  Prosecution of Ordinance Violators;
    12  Disposition of Fines, Penalties and Costs.--Any violation or
    13  failure to comply with any provision of any borough ordinance
    14  shall constitute a summary offense and prosecution for every
    15  such offense shall be according to the practice in the case of
    16  summary convictions. Whenever any borough enforces an ordinance
    17  by means of a civil proceeding, that borough shall be exempt
    18  from the payment of any filing or service fees associated with

     1  the complaint.
     2     Section 2.  This act shall take effect in 60 days.
