                                     AN ACT

     1  Amending Title 42 (Judiciary and Judicial Procedure) of the
     2     Pennsylvania Consolidated Statutes, providing for electronic
     3     recording of custodial interrogation.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Title 42 of the Pennsylvania Consolidated
     7  Statutes is amended by adding a section to read:
     8  § 8704.  Electronic recording of custodial interrogation.
     9     (a)  General rule.--Except as provided in subsection (b),
    10  whenever a person in custody is being interrogated, the
    11  interrogation shall be electronically recorded, if feasible.
    12     (b)  Exception.--If the interrogation of the person in
    13  custody is being conducted at a place of detention, the
    14  interrogation must be electronically recorded.
    15     (c)  Definitions.--As used in this section, the following
    16  words and phrases shall have the meanings given to them in this
    17  subsection:
    18     "Electronically recorded."  Recording by video and audio

     1  means.
     2     Section 2.  This act shall take effect in 60 days.
