                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, providing for theft of fuel.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5     Section 1.  Title 18 of the Pennsylvania Consolidated
     6  Statutes is amended by adding a section to read:
     7  § 3935.  Theft of fuel.
     8     (a)  Offense defined.--A person commits the offense of theft
     9  of fuel if he dispenses fuel into the fuel tank of a motor
    10  vehicle or into a container and leaves the premises of the
    11  establishment which offered the fuel for sale without making
    12  payment for the fuel.
    13     (b)  Grading.--An offense under this section is:
    14         (1)  A summary offense when the offense is a first
    15     offense.


     1         (2)  A misdemeanor of the second degree when the offense
     2     is a second offense. In addition to any other fines or
     3     penalties which may be imposed, a person shall receive a six-
     4     month suspension of their driver's license.
     5         (3)  A felony of the third degree when the offense is a
     6     third offense. In addition to any other fines or penalties
     7     which may be imposed, a person shall receive a one-year
     8     suspension of their driver's license.
     9     Section 2.  This act shall take effect in 60 days.
