                                     AN ACT

     1  Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
     2     act relating to the public school system, including certain
     3     provisions applicable as well to private and parochial
     4     schools; amending, revising, consolidating and changing the
     5     laws relating thereto," providing for basic education funding
     6     for the 2002-2003 school year and for mandatory property tax
     7     relief for the 2003-2004 school year.

     8     The General Assembly of the Commonwealth of Pennsylvania
     9  hereby enacts as follows:
    10     Section 1.  The act of March 10, 1949 (P.L.30, No.14), known
    11  as the Public School Code of 1949, is amended by adding sections
    12  to read:
    13     Section 2502.41.  Basic Education Funding for 2002-2003
    14  School Year.--(a)  For the 2002-2003 school year and each school
    15  year thereafter, the Commonwealth shall pay to each school
    16  district a basic education subsidy which shall be the greater
    17  of:
    18     (1)  the amount the school district received in the prior
    19  year; or
    20     (2) an amount calculated by multiplying the school district's

     1  total students by the school district's market value/personal
     2  income aid ratio and the State average actual instructional
     3  expenditure per student.
     4     (b)  For purposes of this section, a school district's total
     5  students shall be:
     6     (1)  the school district's average daily membership, with all
     7  students counted as one, except students enrolled in half-day
     8  kindergarten, who shall be counted as one-half student;
     9     (2)  plus the school district's average daily membership, so
    10  calculated, multiplied by the percent of children in the school
    11  district receiving temporary assistance to needy families;
    12     (3)  plus one-half student for each of the first five hundred
    13  (500) students of school district enrollment.
    14     Section 2502.42.  Mandatory Property Tax Relief for the 2003-
    15  2004 School Year.--For the 2003-2004 school year, each school
    16  district shall reduce property taxes on homesteads and
    17  farmsteads within the school district by an amount calculated as
    18  follows:
    19     (1)  Sum the amount of property taxes on residential
    20  property, agricultural property and all non-property school
    21  taxes collected by the school district in 2000-2001.
    22     (2)  Multiply the amount from clause (1) by the ratio of the
    23  school district's actual instructional expenditures in 2000-2001
    24  to total expenditures in 2000-2001.
    25     (3)  Divide the amount from clause (2) by the total amount of
    26  personal income in the school district in 1999.
    27     (4)  Multiply the amount from clause (3) by 17.8.
    28     (5)  Add the amount from clause (4) to 0.01.
    29     (6)  Multiply the smaller of 0.90 or the amount from clause
    30  (5) by that portion of the amount of the payment made pursuant

     1  to this section that exceeds the amount paid pursuant to section
     2  2502.40.
     3     Section 2.  This act shall take effect immediately.
