AN ACT

Amending Title 18 (Crimes and Offenses) of the Pennsylvania

2

Consolidated Statutes, in kidnapping, providing for the

3

offense of failure to report missing child; in offenses

4

against the family, further providing for the offense of

5

concealing death of child; and providing for the offense of

6

failure to report the death of child.

The General Assembly hereby declares its intention to enact

8

Caylee's Law in this Commonwealth.

9

The General Assembly of the Commonwealth of Pennsylvania

10

hereby enacts as follows:

11

Section 1.  Title 18 of the Pennsylvania Consolidated

12

Statutes is amended by adding a section to read:

13

§ 2908.1.  Failure to report missing child.

14

(a)  Offense defined.--A parent or guardian is guilty of a

15

misdemeanor of the first degree if:

16

(1)  The parent or guardian knew or should have known

17

that his or her child was a missing child.

(2)  The parent or guardian failed to report his or her

2

child to a law enforcement agency as a missing child within

3

24 hours from when the parent or guardian knew or should have

4

known that the child was a missing child.

(b)  Affirmative defense.--It shall be an affirmative defense

6

to a charge under this section that the person charged had a

7

reasonable belief that a missing person report involving the

8

missing child was made to a law enforcement agency.

9

(c)  Definitions.--As used in this section the following

10

words and phrases shall have the meanings given to them in this

11

subsection:

12

"Child."  A person under 18 years of age.

13

"Missing child."  A child whose whereabouts has not been

14

known to the child's parent or guardian for 24 hours or more.

15

Section 2.  Section 4303 of Title 18 is amended to read:

16

§ 4303.  Concealing death of child.

17

(a)  Offense defined.--A person is guilty of a [misdemeanor

18

of the first] felony of the third degree if he or she endeavors

19

[privately], either alone or by the procurement of others, to

20

conceal the death of [his or her] a child, so that it may not

21

come to light, including whether it was born dead or alive or

22

whether it was murdered or not.

23

(b)  Procedure.--If the same indictment or information

24

charges any person with the murder of [his or her] a child or

25

any other offenses resulting in the death of a child, as well as

26

with the offense of the concealment of the death, the jury may

27

acquit or convict him or her of [both] all offenses, or find him

28

or her guilty of one and acquit him or her of the [other]

29

others.

(c)  Definition.--As used in this section, the term "child"

means a person under 18 years of age.

Section 3.  Title 18 is amended by adding a section to read:

§ 4303.1.  Failure to report death of child.

(a)  Offense defined.--A parent or guardian of a child or

5

other person supervising the welfare of a child is guilty of a

6

misdemeanor of the first degree if:

7

(1)  The parent, guardian or other person supervising the

8

welfare of a child discovers the death of the child.

9

(2)  The parent, guardian or other person supervising the

10

welfare of a child reasonably believes or should have

11

reasonably believed that the death of the child occurred as a

12

result of violence or trauma, whether apparently homicidal,

13

suicidal or accidental, including death due to mechanical,

14

thermal, chemical, electrical or radiational injury,

15

drowning, cave-in or subsidence.

16

(3)  The parent, guardian or other person supervising the

17

welfare of a child fails to report the death of the child to

18

a law enforcement agency within 12 hours of such discovery.

19

(b)  Affirmative defense.--It shall be an affirmative defense

20

to a charge under this section that:

21

(1)  the person charged had a reasonable belief that the

22

child's death was reported to a law enforcement agency; or

23

(2)  a physician certified the child's death.

24

(c)  Procedure.--If the same indictment or information

25

charges any person with the murder of a child or with any other

26

offense resulting in the death of the child, as well as with the

27

offense of the failure to report the death of the child, the

28

jury may acquit or convict him or her of all offenses or find

29

him or her guilty of one offense and acquit him or her of the

30

others.

(d)  Definitions.--As used in this section, the following

2

words and phrases shall have the meanings given to them in this

3

subsection:

4

"Child."  A person under 18 years of age.

5

"Person supervising the welfare of a child."  A person other

6

than a parent or guardian that provides care, education,

7

training or control of a child.

8

Section 4.  This act shall take effect immediately.
